Bail Conditions in a Mule-Account Case
Bail comes with conditions, and knowing each one helps you keep your bail.

What are bail conditions?
Bail lets you stay at home while your mule-account case goes on. In return, the court or police set conditions you must follow.
The conditions exist to make sure you come back to court and do not interfere with the case. If you break one, you can lose your bail.
Sections 424A, 424B and 424C are bailable offences, so bail is a right. The court or police decide the amount and the conditions.
In court you may feel rushed and simply nod. Read each condition again afterwards so you know exactly what it asks of you.
Going to every court date
The most basic condition is to attend court on every date. This is the main point of bail.
If you miss a date without a good reason, the court can issue a warrant for your arrest and cancel your bail. Write down every date and arrive early.
If you are sick or have a real emergency, call your lawyer at once so the court is told. Do not just stay away.
Handing in your passport
The court can ask you to hand in your passport, so you cannot leave the country while the case runs.
You do not lose it for good. You can ask the court to release it for a short, genuine trip.
If you must travel for work or family, do not just go. Ask your lawyer to apply for the passport’s temporary release well before the trip.
Reporting to a police station
Some people on bail must report to a named police station on set dates, such as once a week or once a month.
Treat each date as a fixed appointment. A missed report, even by accident, can be treated as a breach.
If the dates clash with work, or you move house, tell your lawyer. They can ask the court to change the arrangement.
The surety and the bail money
Bail can need a surety and a sum of money set by the court. The surety is an adult who promises the court you will attend. They may need to show their identity card and that they can cover the sum.
Find a willing surety early, before your court date, so bail is not delayed.
The sum can reflect how serious the charge is. Section 424B carries up to seven years in jail [f1]. Section 424C, the most serious, carries up to ten years [f2], and a heavier charge can bring stricter terms.
Can you change a condition?
Yes. Conditions are not always fixed for the whole case. If one stops being workable, a lawyer can apply to the court to change it.
An honest request made in advance is better than an excuse after a breach. This applies to reporting dates, passport release and other terms.
Article 5(3) of the Federal Constitution gives you the right to a lawyer of your choice [f3]. If you are arrested, a lawyer can speak for you on bail. Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f4], but your bail depends on your own case.
If a condition is already hard to meet, a lawyer can prepare the application to change it before you fall behind. If you are considering legal representation, request independent lawyer contact on WhatsApp with a brief, general message and no documents.
Keep a written list of your conditions
Write your conditions down in one place, in your own words. List what each one asks and any dates attached.
Keep the list with your case papers and check it before you travel, move house or change jobs. If anything is unclear, ask your lawyer before you act.
Bail conditions are not a finding of guilt
Bail conditions only manage your freedom while the case runs. Following them does not mean you admit anything.
Keeping to them lets you stay at home and prepare your defence. If your life changes, talk to your lawyer so the conditions can be reviewed.

What conditions can come with bail?
Common ones are attending every court date, handing in your passport, reporting to a police station on set dates, and having a surety. A surety is a person who promises the court you will turn up. The mix depends on your case and the court.
What happens if I break a bail condition?
The court can cancel your bail and send you back into custody, and the bail money can be at risk. Even one missed reporting date can count. If you cannot meet a condition, ask a lawyer to apply for a change before the date, not after.
Can bail conditions be changed?
Yes. If a condition stops being workable, for example a job posting that clashes with reporting dates, a lawyer can apply to the court to change it. An honest request made in advance is better than an excuse after a breach.
Do conditions depend on the section I am charged under?
They can. The court or police set the conditions and look at how serious the offence is. A section with a heavier maximum can bring stricter terms, so know exactly what you are charged with before bail is argued.
