What is this consultation for?

A frozen account consultation is the first real step towards understanding your situation. Your account may have been frozen under AMLA, or blocked under the newer police power that allows action straight away without a court order [f4]. Either way, the consultation answers one question: where do you stand, and what can be done?

A lawyer goes through the facts of your case and gives you an honest, realistic view of your options.

What happens when you get in touch?

You start with a short WhatsApp message: when the account was frozen, which bank, and whether the police have been in contact. Where appropriate, we can help connect you with an independent lawyer, who may ask a few questions before the consultation is arranged.

What should you bring?

Bring any documents linked to the freeze. That usually means the bank’s freeze notice or SMS, recent bank statements, any letter or call record from the police or CCID, and your ID.

Some people have had no formal notice of why the account was frozen. In the consultation, the lawyer helps you work out the likely reason from the pattern of the freeze and what you have noticed.

What does the lawyer check?

The lawyer goes through a few key questions with you. Did the Public Prosecutor order the freeze under AMLA [f1]? Or was it the police power that lets a Sergeant freeze an account and block transactions straight away, without a court order [f4]? Is there a criminal investigation, or is this a bank compliance hold?

The answer matters. An AMLA Section 44 freeze lasts up to 90 days unless you are charged, and a later seizure order lapses after 18 months if no charge is brought [f2]. Knowing which kind you have changes what the realistic next steps are.

Can money be released while the account stays frozen?

Sometimes, yes. Section 44A of AMLA lets an account holder apply in writing to the enforcement agency to change a freeze order to release money for reasonable living or business expenses [f3]. The consultation covers whether this is realistic for you, what evidence it needs, and how to prepare it.

If your case involves a suspected mule account and not a simple AMLA freeze, the consultation also covers the defence side of the case, because the two can be linked.

What do you leave with?

You leave with a plain assessment of your situation, the likely legal basis for the freeze and realistic next steps. Depending on your case, that could be formal representation, a letter to the bank, an application to vary the freeze, or advice on what to watch while the case moves on.

No honest consultation can promise a particular result or timeline. Be very careful with any lawyer who promises either.

How much does it cost?

Costs depend on how complex the case is and are discussed openly before you commit. The Malaysian Bar Council sets professional guidance on lawyer-client costs, so any lawyer should explain their fees clearly at the start [f5]. If your income qualifies, ask the Legal Aid Department about low-cost or free help [f6].

Is the consultation confidential?

What you tell a lawyer during a consultation, for the purpose of getting advice, is generally protected by lawyer-client privilege, with limited exceptions. This applies whether or not you go on to hire that lawyer. That is why you can give the lawyer a full and honest account of what happened.

What actually happens during a frozen account consultation?

A lawyer listens to what you say about the freeze, looks at your documents, and works out the likely legal basis for it. You then get a plain explanation of your situation and a set of realistic options, not a script or a sales pitch.

Is the consultation confidential?

What you tell the lawyer for the purpose of getting advice is generally protected by lawyer-client privilege under the Evidence Act, with limited exceptions, whether or not you hire that lawyer afterwards. Your first WhatsApp message goes to the referral service, not to a lawyer, so keep it to the basics.

What documents should I bring to the consultation?

Bring the bank's freeze notice or SMS if you have it, recent bank statements, any letter or call record from the police or CCID, and your ID. If you have had no formal notice, the lawyer can help you work out the likely reason from the pattern of the freeze.

How much does a consultation cost?

Fees depend on how complex the case is, and the lawyer explains them before you commit to anything. The Malaysian Bar Council sets professional guidance on lawyer-client costs, so you should always know the fee structure upfront [f5]. If your income is low, ask the Legal Aid Department whether you qualify.

Do I need a consultation if I think the freeze was a mistake?

Not always. Not every restriction needs a lawyer. If the bank has only put the account under its own review, you can sometimes resolve it by giving the bank the documents it asks for (see [bank compliance holds](/bank-compliance-hold/)). A lawyer helps most when the police, an enforcement freeze under AMLA or a charge is involved, because then the legal basis has to be checked before anything can be corrected. A consultation is a good way to find out which situation you are in.

Can I have a consultation if I am not in Kuala Lumpur?

Yes. A consultation starts with a WhatsApp message, so where you live does not matter. Documents can be shared online and calls arranged anywhere in Malaysia.
