What a Lawyer Can Do for You
From police station to court, a lawyer handles the steps that protect your case.

What does a lawyer actually do?
You may know a lawyer can help but not how. In a frozen account or mule account case, a lawyer does specific, concrete things at each stage. Knowing what they are helps you decide whether you need one.
Under the Legal Profession Act 1976, an advocate and solicitor can appear and argue in every court in Malaysia. [f1] But a lawyer’s work starts long before court.
At the police station
The police stage matters. If you are arrested, CPC Section 28A gives you the right to consult a lawyer before questioning. [f2] Article 5(3) of the Federal Constitution says the same. [f4] If you attend as a witness and are not arrested, you can still ask to speak to a lawyer first, but you have no right to have one in the room.
Before your statement, your lawyer meets you to understand the facts and spot the risks. Lawyers have no general right to sit in during police questioning, though some officers allow it. If yours does, your lawyer can advise you during the session.
Your lawyer can explain beforehand that you must answer police questions truthfully, but may decline questions whose answers would expose you to a criminal charge. Ask to read the written statement carefully before you sign it.
Your lawyer also deals with the Investigation Officer for you. Your lawyer asks for updates and hands in evidence that supports you. See our guide on having a lawyer at the police station.
During the investigation
While the investigation goes on, your lawyer helps you collect and organise evidence. That means bank statements, WhatsApp messages, work records, and any document that backs up your account of events.
Your lawyer writes a timeline of what happened and picks out the strongest points in your defence. Your lawyer may also write to the Deputy Public Prosecutor with your side of the story before any decision to charge. That letter puts your side before the prosecutor, who can decide on an NFA (No Further Action).
Applying to vary a freeze order
If your account is frozen and you need money, your lawyer can act. AMLA Section 44A allows a person to apply in writing to the enforcement agency to vary a section 44 freeze order. [f3] Your lawyer can ask for enough money to be released to cover reasonable living costs, rent, medical bills and legal fees.
The application needs careful drafting and supporting evidence. Your lawyer prepares it, files it and argues it. You can write to the agency yourself, but a lawyer can help; see lawyer vs self-representation for more.
If you are charged
If the DPP decides to charge you, your lawyer’s role grows. Under the Legal Profession Act 1976, your lawyer appears in court for you. [f1] Your lawyer enters your plea, applies for bail and starts preparing your defence for trial.
At trial, your lawyer cross-examines the prosecution’s witnesses, challenges evidence that should not be admitted, calls your witnesses and makes the legal arguments. Throughout, the law requires your lawyer to act in your interests and keep to professional standards. [f5]
Court cases follow strict rules of procedure. A lawyer who handles financial crime cases can explain these rules and use them for you.
What a lawyer cannot do
A lawyer cannot promise a particular result, and cannot make the police drop an investigation. A lawyer cannot force a bank to unfreeze your account at once, and cannot change what happened.
What a lawyer can do is act within the law for you, explain your options and deal with the police, prosecutors and courts.
When should you get a lawyer?
Think about where your case is now.
At the police stage, a lawyer helps you avoid statement mistakes that are hard to undo. During the investigation, a lawyer builds your defence early. If you are charged, you need a lawyer in court.
The earlier a lawyer joins, the more they can do. A lawyer who joins at the statement stage has more room to protect you than one who joins after a charge.
If cost is a worry, look at the legal aid options in Malaysia. Our guide on finding a lawyer explains how to start.

Can a lawyer get my frozen account unfrozen?
No lawyer can promise that, but a lawyer can take concrete steps towards it. Under AMLA Section 44A, a lawyer can apply in writing to the enforcement agency to vary a section 44 freeze order so you can use money for living costs and legal fees. A lawyer can also write to the bank and the authorities asking for the freeze to be reviewed.
What does a lawyer do at the police stage?
A lawyer prepares you before your statement session. If you are arrested, CPC Section 28A gives you the right to consult a lawyer before questioning. Whether your lawyer can sit in during questioning is up to the officer. Your lawyer can also deal with the Investigation Officer for you and help you keep and organise evidence for your defence.
What does a lawyer do if I am charged in court?
Under the Legal Profession Act 1976, a lawyer represents you in court. Your lawyer enters your plea, applies for bail, challenges the prosecution's evidence, cross-examines witnesses and presents your defence. Only a qualified lawyer can represent you in court.
Can a lawyer stop the police from investigating me?
No. But a lawyer can make sure the investigation follows the proper procedure, protect your rights along the way, and prepare your defence so you are ready whatever the outcome.
How much does a lawyer cost for a frozen account case?
It depends on the lawyer and how complex the case is. Ask about fees at the start, including for a first consultation. Later fees depend on the stage and the work involved. If you cannot afford a lawyer, legal aid may be available, for example through the National Legal Aid Foundation (YBGK) or the Legal Aid Department. Check their rules.
What is the difference between a lawyer and representing myself?
A lawyer knows the law, the courtroom and the procedure. A lawyer knows how to argue, which evidence to use and how to protect your rights at each stage. On your own you handle all of this yourself, with a higher risk of mistakes that hurt your case.
Can a lawyer help if my case is already in court?
Yes. A lawyer can take over at any stage. Even if you started alone, a lawyer can plan the defence, handle the evidence and argue for you before the judge from the day they join.
