What NFA means for your case

NFA stands for “no further action”. After the Deputy Public Prosecutor (DPP) reads your investigation paper, if the evidence does not support a charge, the DPP decides on NFA. [f2] It means your case will not go to court.

An NFA is good news: no charge, no trial and no conviction. For people caught up in mule account investigations who did nothing wrong, it is the result they were hoping for.

After an NFA, the next step is getting your frozen account working again.

How an NFA decision is made

The police finish their investigation and send the investigation paper to the AG’s Chambers. The DPP handling your case then reviews the evidence. [f1]

If the DPP decides not to charge, the file is marked NFA. The Investigating Officer (IO) is told, and should pass this on to you or your lawyer.

Your lawyer’s written representations to the DPP may support an NFA. Evidence that you are innocent, a clear timeline of events and proof that you were tricked can all be part of them.

Getting your NFA letter

The NFA letter is the most important document at this stage. It confirms in writing that you will not be charged, and you need it to get your account unfrozen.

Your lawyer can ask the IO or the AG’s Chambers for the letter. The IO may phone you with the news, but a phone call is not enough for your bank. You need it in writing.

If the letter is slow to arrive, your lawyer can write formally to the DPP’s office asking for written confirmation. Keep copies of every letter and email.

Taking the NFA letter to your bank

Banks do not unfreeze accounts automatically after an NFA. [f4] You need to take the NFA letter to your bank and ask for the unfreeze formally.

Before you go, prepare the original NFA letter and copies, your IC, your account details, and a cover letter from your lawyer asking for the unfreeze. The lawyer’s letter should quote the investigation case number and the NFA.

Hand everything to the bank’s compliance department. Ask for a written acknowledgement and a reference number for follow-up.

How long does the unfreeze take?

Once the bank has your NFA documents, its compliance team checks the NFA letter with the authorities, reviews your account and then lifts the freeze. [f5] Ask the bank how long it expects to take.

If your account was frozen under a police order rather than the bank’s own compliance hold, it may take longer. The bank needs the police to confirm the order has been lifted.

If there is no progress, your lawyer can follow up with the bank in writing.

An NFA is not an acquittal

An NFA and an acquittal are legally different. [f3] An acquittal is a court’s finding after a trial that you are not guilty. An NFA is the prosecution’s decision not to charge you.

This matters in one way. Because an NFA is not a court order, the case can in theory be reopened if new evidence comes up. The DPP has already weighed the evidence, so something new and significant would be needed.

For now, an NFA means you were not charged and you have no conviction. Under CPC Section 376 the Attorney General, as Public Prosecutor, controls all criminal prosecutions and decides whether to charge. Once a trial has started, CPC Section 254 lets the prosecution stop the case before judgment; the accused is then discharged, which is not an acquittal unless the court says so. [f6]

What to do once your account is unfrozen

Download and save your full bank statements for the period of the freeze. Reset any automatic payments or standing instructions that failed while the account was frozen.

If your salary was paid elsewhere during the freeze, tell your employer your original account works again. Check that online banking, your debit card and DuitNow are all working.

Even with an NFA, the unfreeze can be slow or complicated. A lawyer who has handled frozen account cases can write straight to the bank’s compliance department and, if needed, take it to Bank Negara Malaysia.

If your bank refuses to unfreeze despite the NFA, or the police contact you again afterwards, speak to a lawyer straight away.

What does NFA mean exactly?

NFA stands for "no further action". It means the Deputy Public Prosecutor has reviewed your case and decided not to file a criminal charge, based on the evidence in the investigation paper. It opens the way to getting your account unfrozen.

How do I get my NFA letter?

Your lawyer can ask the Investigating Officer or the AG's Chambers for it. Sometimes the IO tells you directly. If you have heard nothing, your lawyer can write to the DPP's office to confirm the NFA and ask for a letter you can show your bank.

Will my bank automatically unfreeze my account after NFA?

No. The bank needs to see the NFA letter or written confirmation from the authorities. You or your lawyer take the NFA letter, your IC and a cover letter asking for the unfreeze to the branch. The bank's compliance department then handles it. Ask the bank how long it expects to take.

Can my case be reopened after NFA?

In theory, yes. An NFA is not an acquittal by a court, so the AG's Chambers can look at the case again if new evidence comes up. The authorities have already weighed the evidence, so something new would be needed.

Is NFA the same as being found not guilty?

No. An acquittal (a not guilty finding) comes from a court after a trial. An NFA is a decision by the prosecution not to charge you. Either way you are not convicted, but legally they differ: an NFA does not give you a court order of acquittal.

What if my bank refuses to unfreeze after NFA?

If the bank delays or refuses despite your NFA letter, your lawyer can write formally to its compliance department, pointing to the NFA. If that fails, you can complain to Bank Negara Malaysia. If that is still not enough, a court application may be needed to make the bank lift the freeze.
