What does statement preparation mean?

Being called in to give a statement to JSJK (Jabatan Siasatan Jenayah Komersil, also known as CCID) can frighten anyone, especially if you believe you did nothing wrong. [f1] Preparation means you do not walk into that room with no idea what to expect.

It is not about scripting answers or telling you what to say. It makes sure you understand the process, know your rights, and can answer clearly instead of guessing under pressure.

Why does preparation matter so much now?

What you say in your statement becomes part of the investigation record. In a suspected mule account case, the questions may cover how you got the account, who could use it, and whether you knew how it was being used.

These are the points that matter if you are later charged under Section 424B. That section covers giving someone else control of your own account without lawful authority or purpose, and carries a fine of RM10,000 to RM100,000, or 1 to 7 years in jail, or both. [f3]

An anxious answer can cause confusion that is hard to clear up later.

What does the lawyer go over with you?

The lawyer goes over the events in the order you remember them, any documents that support your account (bank statements, messages, transaction records), and what CCID is likely to focus on in a case like yours.

The lawyer also explains what “control” means in law, and why what you knew and why you acted matter to your defence under both Section 424A and Section 424B.

By the end, you should be clear about what happened, in what order, and how to explain it simply.

Can a lawyer be present during the interview?

If you are arrested, CPC Section 28A gives you the right to consult a lawyer before questioning. [f2] If you are called in as a witness, whether the lawyer can be in the room is up to the officer. Either way, a lawyer can brief you fully beforehand. Our page on what a lawyer can do explains this plainly.

For the fuller picture of the whole process, see our guide on what a lawyer can do before your statement.

What should you avoid saying?

Do not guess when you are unsure. Do not offer more than you are asked. Do not speculate about what other people did or meant.

Stick to what you personally know is true.

Fear can make people over-explain, which can create contradictions and more questions. A calm, accurate and suitably brief statement serves you far better.

What if you already have a date?

Do not wait. Even a short time can be enough for a lawyer to go over the key facts, explain what to expect, and help you walk in prepared instead of anxious.

If you cannot afford full representation, ask the Legal Aid Department, which may give legal help at low or no cost to Malaysians who meet its income criteria. [f5]

What happens after the statement?

After your statement, CCID continues the investigation. It may interview you again or ask for documents before deciding whether to charge. Police have a large caseload here: they detected 46,048 mule accounts in 2023 and 50,295 in 2024. [f6]

Your statement is one part of a longer process. If your case moves towards a charge, our page on full mule account defence representation covers each stage that follows.

How do you get started?

Whether your statement is tomorrow or weeks away, start the same way: send a short WhatsApp message about your situation, and, where appropriate, we can help connect you with an independent lawyer who can begin preparing you.

What does statement preparation actually involve?

A lawyer goes over the facts with you, works out what CCID is likely to focus on from how mule account cases are investigated, and practises clear, accurate answers with you. It is not coaching you to say anything untrue. It is about cutting the mistakes people make out of fear.

Can a lawyer attend the JSJK interview with me?

If you are arrested, CPC Section 28A and Article 5(3) of the Federal Constitution give you the right to consult a lawyer before questioning [f2]. If you are called in as a witness, whether a lawyer may be in the room is up to the officer. The lawyer explains this during preparation so you know what to expect on the day.

What should I avoid saying during my statement?

Do not guess when you are unsure, do not offer more than you are asked, and do not speculate about other people involved. Stick to what you know is true. A calm, accurate statement serves you better than an anxious one that over-explains.

How much notice do I usually get before a JSJK statement?

Notice varies, and no one can promise how much you will get. Whatever notice you get, contact a lawyer as soon as you know the date, so there is time to prepare.

What if I already have a date for my statement?

Get in touch straight away. Even a few days before the statement can give a lawyer time to go over the key facts with you and explain what to expect. Do not wait until the day itself to look for help.

Does preparing for a statement affect my frozen account?

It can. How your statement goes may affect what the authorities decide about the account. An AMLA section 44 freeze lasts up to 90 days unless you are charged, and a later seizure order lapses after 18 months if no charge is brought [f4]. The lawyer looks at both during preparation.
