Your account is frozen: start here
You may have found out at an ATM, through a failed transfer, or from a call from your bank. It is frightening, but there are clear steps you can take.
Follow the steps below in order. Each one builds on the last, and together they protect your position while you work to get your account unfrozen.
A freeze is not a conviction. It is a hold during an investigation, and the law gives you specific rights to respond.
Step 1: Call your bank now
Call your bank’s customer service line and ask these three questions.
Which authority ordered the freeze? This decides which legal process applies. A police freeze under CPC Section 116D follows a different path from an AMLA order made by the Public Prosecutor. [f1]
What is the reference number? Every freeze order has one. Write it down; your lawyer will need it.
Is money coming in also blocked? Some freezes block only payments going out; others block everything. This tells you whether your salary or business income can still reach the account.
Write down the date and time of the call, the officer’s name and everything they say. If you challenge the freeze later, this record becomes part of your evidence.
Step 2: Avoid these mistakes
You can hurt your own case in the first 24 hours. Do not do the following.
Do not open a new account to move money around the freeze. It can look like an attempt to get around the freeze and can create new legal problems, including under the mule account laws.
Do not rush to withdraw cash from your other accounts. Large or unusual withdrawals can trigger more alerts in the banking system.
Do not delete messages, emails or transaction records. They are your evidence: if the freeze is linked to a transaction you made in good faith, these records show your side. Start gathering your evidence now.
Do not post about the freeze on social media. Anything you say in public can be used in the investigation. Keep the details between you, your lawyer and close family.
Step 3: Contact a lawyer
If you are arrested, Article 5(3) of the Federal Constitution says you shall be allowed to consult, and be defended by, a lawyer of your choice. [f4] You can also ask to speak to a lawyer before giving any statement.
A lawyer who handles AMLA and frozen account cases can do three things you cannot easily do alone.
First, confirm which authority froze the account and on what legal basis. Second, apply in writing to the enforcement agency for a variation under AMLA Section 44A so you can use money for rent, food, utilities and medical bills. [f3] Third, advise you before you give investigators a statement.
If you do not have a lawyer yet, our guide to finding legal help explains what to look for and what to ask.
Step 4: Apply for money to live on
You do not have to sit and wait while your money is locked. AMLA Section 44A allows you to apply in writing to the enforcement agency to vary a section 44 freeze order. [f3]
A variation application asks the enforcement agency to release part of your frozen money for essential costs. These include rent or mortgage, food and household costs, utility bills, medical costs and school fees.
Your lawyer will prepare the application. To support it, collect your tenancy agreement or mortgage statement, recent utility bills, medical receipts or prescriptions, school fee invoices, and a list of your essential monthly costs.
Clear documents make it easier for the officer to decide.
Extra steps for business owners
If your business account is frozen, salaries, supplier payments and running costs all stop.
List your business obligations now. Collect employment contracts, supplier agreements, the lease for your premises, and every payment due in the next 30 days.
Tell your accountant or bookkeeper. They can prepare a clear financial summary showing that your business transactions are lawful. This helps both the variation application and the investigation.
Check whether personal and business money were mixed. If your personal account was used for business, or business money went through a personal account, record the business purpose of each transaction. Mixed accounts can get closer checks during investigations.
Talk to your lawyer about keeping the business running. A variation application for a business account can ask for salaries and key supplier payments. Show that staff and others depend on that money.
How long can a freeze last?
Knowing the time limits helps you plan. [f2]
An agency freeze under AMLA Section 44 ends after 90 days if no charge is filed. [f6] Under AMLA Section 52A, a seizure order ends after 18 months if no charge is filed. The limit was 12 months until a 2025 amendment took effect on 1 March 2026. A Malaysian court has ordered frozen money returned when an order ran past its legal deadline without a charge.
A police freeze under CPC Section 116D also ends after 18 months if no charge is filed. Until then it stays while the investigation continues. With your lawyer, you can apply to the Sessions Court to vary or revoke it.
How fast a case is settled depends on its facts, including how quickly the account holder cooperates and hands over documents. Ask your lawyer for a realistic estimate once they have seen your documents.
Could a 997 report have caused your freeze?
The National Scam Response Centre (NSRC) runs the 997 hotline. When a scam victim calls 997, the system can help banks freeze the receiving account quickly. [f5]
So your account may have been frozen because someone reported a transaction that passed through it. You may not have known the sender was a scam victim; for example, you may have sold something online and been paid from a hijacked account.
If your freeze is linked to a 997 report, the investigation will trace where the money went. Your bank statements, sales records and messages with the buyer become key evidence. Collect them now and give them to your lawyer.
Your rights during a freeze
A frozen account does not freeze your rights. Malaysian law protects you at every stage.
Ask in writing. You can ask your bank which authority or order is behind the freeze, and for any reference number. The bank may not be allowed to tell you about any suspicious transaction report.
Right to a lawyer. If you are arrested, Article 5(3) of the Federal Constitution gives you the right to consult a lawyer. [f4] If investigators ask for a statement, you can ask to speak to a lawyer first. Whether your lawyer can sit in is the officer’s decision.
Right to apply for a variation. Under AMLA Section 44A, you can apply in writing to the enforcement agency to use money for essential living costs. [f3] The agency decides whether to vary the order.
Right to challenge. You can challenge the freeze in court by judicial review (asking a court to check whether the order was lawful). A lawyer can advise whether a challenge is possible in your case.

What should I do first when my bank account is frozen?
Call your bank now and ask three things: which authority ordered the freeze, the reference number, and whether money coming in is also blocked. Write down the date, the officer's name and everything they tell you. The answers decide which legal process applies to you.
Can I apply to use my frozen funds for living expenses?
Yes. Under AMLA Section 44A, you can apply in writing to the enforcement agency to vary a section 44 freeze order so you can use money for rent, food, utilities and medical costs. [f3] A lawyer can prepare and file the application for you.
How long can my bank account stay frozen in Malaysia?
An agency freeze under AMLA Section 44 ends after 90 days if you are not charged. Under AMLA Section 52A, a seizure order lapses if the person is not charged within 18 months (raised from 12 months by a 2025 amendment in force since 1 March 2026). A police freeze under CPC Section 116D also ends after 18 months without a charge, and you can apply to the Sessions Court to vary or revoke it earlier.
Should I open a new bank account if my current one is frozen?
Do not open a new account to move money around the freeze. The authorities may see it as trying to obstruct the investigation, which adds to your legal trouble. If you need an account for your salary, talk to your lawyer first.
Do I need a lawyer if my account is frozen?
If you are arrested, Article 5(3) of the Federal Constitution gives you the right to consult a lawyer. You are not required to have one. But a lawyer who handles AMLA cases can find out which authority froze the account, apply for money for living costs, and protect your rights during the investigation.
My business account is frozen. Can I still pay staff and suppliers?
A frozen business account stops all payments going out. You can apply in writing to the enforcement agency under AMLA Section 44A for a variation that covers essential business costs such as salaries. Collect your staff contracts and supplier agreements, because they show why the application is urgent.
Was my account frozen because someone reported me to 997?
Possibly. The NSRC 997 hotline triggers quick freezes on accounts that scam victims report. [f5] If your account received money from a scam victim, even without your knowledge, the 997 system may have flagged it. Your bank may be able to confirm where the freeze order came from.
