Your account is frozen: start here

Your account is frozen. You cannot withdraw money, pay bills or transfer funds. It is stressful, and what you do now shapes what happens next.

Follow the steps below in order.

Step 1: Call your bank

Call your bank’s customer service line and confirm the freeze. Ask these three questions and write down the answers:

  1. Which authority issued the freeze order?
  2. What is the reference number for the order?
  3. When was the freeze applied?

You can ask your bank which authority or order is behind the freeze. [f4] The bank may not be allowed to tell you about any suspicious transaction report. Write down the name of the person you spoke to and the date and time of the call. You will need this later.

Step 2: Do not move money or open new accounts

This is the most important warning in this guide. Do not open a new bank account, and do not ask anyone to open one for you. Do not move money between other accounts to get around the freeze. [f5]

Moving money during an active investigation can be treated as obstruction. It can also lead to charges under the mule account laws. For now, the safest thing is to leave your money alone.

Step 3: Keep every record

Do not delete anything. Keep every document, message and record about your account or your money, including:

  • bank statements (download or screenshot them from other accounts you can still open)
  • transaction receipts and transfer confirmations
  • WhatsApp messages, emails or any other messages about the transactions in question
  • job letters, payslips or business records that show where your money came from

These records are your evidence. A lawyer will use them to show that your money is legitimate. Read more about how to prepare your evidence.

Step 4: Contact a lawyer

You can hire a lawyer now. If you are arrested, Article 5(3) of the Federal Constitution guarantees your right to consult and be defended by a lawyer of your choice. [f3]

Contact a lawyer who handles AMLA and frozen account cases. The earlier you do, the more options you keep. A lawyer can work out which legal process applies, apply to vary the freeze for living costs, and represent you if investigators contact you.

If you do not have a lawyer, our guide on finding the right legal help explains where to start.

Step 5: Write down what happened

While the details are fresh, write a timeline. Note when you first noticed the freeze, what the bank told you, and any contact with police or investigators.

If you know which transactions led to the freeze, write down what you know: who sent or received the money, why, and what documents you have. This timeline becomes the base of your case.

What not to do

These mistakes can make things worse. Avoid them completely.

Do not contact the person who sent or received the suspicious money. If the freeze is about a transaction with someone else, do not call, message or meet them. Contact during an investigation can be read as working together or tampering with a witness.

Do not post about your case on social media. Anything you post can be used in the investigation. Keep the details between you and your lawyer.

Do not ignore calls from investigators. If police or investigators contact you, you can ask to speak to your lawyer before you answer questions. Cooperate through the proper channels while protecting your rights.

Your rights right now

Your account is frozen, but you still have important rights.

You can ask your bank in writing which authority or order froze your account, though it may not be allowed to tell you about any suspicious transaction report.

You can speak to a lawyer at every stage, from the first phone call to any court hearing, and an arrested person has the right to consult one. [f3]

An AMLA Section 44 freeze lasts up to 90 days unless you are charged. [f2] A later seizure order lapses after 18 months if no charge is filed.

Police can freeze accounts without a court order under CPC Section 116D. [f1] That does not leave you without options. A lawyer may be able to challenge the freeze if the grounds are weak or the investigation has stalled.

What happens after the first hour?

Once you have done these five steps, you have a clear place to start. What comes next depends on which authority issued the freeze and what the investigation is about.

Your lawyer will guide you through the full process, including applying to vary the freeze, answering investigators and preparing your case. The notes you made in this first hour give your lawyer a clear place to start.

A frozen account does not mean you are guilty

The system aims to catch crime, but people who did nothing wrong get caught up in it too. A freeze means the authorities are investigating, and you have every right to defend yourself.

A short WhatsApp message explaining your situation is enough for us to refer you to a lawyer who can tell you where you stand and what to do next.

What is the very first thing I should do when my account is frozen?

Call your bank and confirm the freeze. Ask which authority issued the order and for any reference number. Write down who you spoke to, with the date and time, because every later step depends on this.

Can I open a new bank account while my current one is frozen?

Do not open a new account during an active investigation. It can look like an attempt to get around the freeze or obstruct the investigation, and it may lead to more legal trouble.

Do I have the right to a lawyer when my account is frozen?

You can hire a lawyer at any point, and it is best to do it early. If you are arrested, Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice.

How long can the police keep my account frozen?

An AMLA Section 44 freeze lasts up to 90 days unless you are charged, and a later seizure order lapses after 18 months if no charge is filed (Section 52A). A police freeze under CPC Section 116D lapses after 18 months if no prosecution starts, and you can apply to the Sessions Court to vary it earlier.

Should I delete messages or transaction records related to my account?

Never delete any records. Bank statements, transaction histories, chats and emails that explain your transactions are evidence for your case. Deleting them can be seen as tampering and will hurt you.

Can the bank tell me why my account was frozen?

You can ask your bank in writing which authority or order is behind the freeze and for any reference number. The bank may not know the full reason for the investigation, and it may not be allowed to tell you about any suspicious transaction report.

What if I need money for daily expenses while my account is frozen?

Under AMLA Section 44A, you can apply in writing to the enforcement agency to vary the freeze order so that basic living costs can be paid. A lawyer can prepare this application for you. Meanwhile, money in accounts at other banks that are not frozen can still be used.
