Is Lawyer Consultation Confidential?
Legal professional privilege under the Evidence Act protects what you tell your lawyer when seeking legal advice.

Does the law protect what you tell your lawyer?
Yes, in general. Some people put off seeing a lawyer because they worry about where their information will go. That worry is natural when a police investigation or a frozen bank account is involved. Malaysian law protects what you tell your lawyer.
Evidence Act 1950 Section 126 says no lawyer may at any time disclose anything their client told them without the client’s express consent. [f1]
What is legal professional privilege?
Legal professional privilege is the rule that protects what passes between you and your lawyer. It applies to communications made to get legal advice. [f2] When you talk to your lawyer about a frozen account, a mule account investigation or any other legal matter, that conversation is protected.
It covers both spoken words and documents. [f3] Talking in person, a WhatsApp message to your lawyer, an email or papers you hand over are all protected, and your lawyer cannot be forced to reveal them.
This protection is for what you tell the lawyer. This website is an independent information and referral service, not a lawyer. So a message sent here before you reach a lawyer should hold only the basic facts.
The privilege belongs to you
It helps to know that the privilege belongs to you, the client, not to the lawyer. [f4] Your lawyer cannot give it up without your express consent. Only you can decide to share what was discussed.
So your lawyer cannot choose to tell the police, the court or anyone else what you said. Your lawyer is legally bound to keep it confidential unless you agree otherwise. For what a lawyer can do for your case, see our finding legal help guide.
What is protected?
The privilege covers what you tell your lawyer about your case in the course of their work for you. That includes:
- the advice your lawyer gives you;
- notes your lawyer takes at your meetings;
- documents you share with your lawyer to get legal advice.
Whether Section 126 covers a first consultation before you formally hire the lawyer can depend on the facts. Ask the lawyer to confirm confidentiality at the start, and ask about any fee before the consultation begins.
What is not protected?
The privilege has limits. It does not protect communications made to further an illegal purpose, such as using a meeting with a lawyer to plan something illegal. It also does not cover facts that show a crime or fraud has happened since the lawyer was hired.
Telling your lawyer about past events is protected. Be honest about what happened so your lawyer can advise you properly. The law encourages that honesty by keeping what you say confidential, and your lawyer can only help if they know the full story.
What happens to a lawyer who breaks confidentiality?
Under the Legal Profession Act 1976, a lawyer who breaches client confidentiality faces serious consequences. [f5] The Advocates and Solicitors Disciplinary Board can impose penalties ranging from a fine to suspension or being struck off the roll.
Keeping your confidence is a basic ethical duty every lawyer owes every client, and breaching it can bring serious penalties.
Why this matters in a frozen or mule account case
In these cases, what you tell your lawyer can be sensitive. You may need to explain how money moved through your account, who had access or whose instructions you followed. Your lawyer needs these details to build your defence.
If you hold things back for fear they will be shared, your lawyer cannot help you properly. Privilege exists so you can speak freely.
Your next step
If you have been putting off talking to a lawyer because you were unsure the conversation would stay private, Evidence Act Section 126 protects you. [f1] The Legal Profession Act 1976 backs that protection with disciplinary action. [f5]
Whether you need advice on a police statement, a frozen account or another legal problem, the first step is speaking with a lawyer. Our guide on what to do now helps you take that step.

Can the police force my lawyer to reveal what I told them?
In general, no. Evidence Act Section 126 bars a lawyer from disclosing what you told them as their client without your express consent. The police cannot make your lawyer reveal what you discussed. This holds even if you are under investigation or have been charged.
Does the privilege cover WhatsApp messages to my lawyer?
Privilege covers spoken and written communications made to your lawyer to get legal advice. So WhatsApp messages sent directly to your own lawyer about your case can be covered. A message to this independent referral service is not a message to your lawyer: keep it to the basic facts and give the full detail once you are speaking with the lawyer.
What if I tell my lawyer I committed a crime?
What you tell your lawyer about past events is protected, and your lawyer cannot reveal it. But a lawyer cannot help you commit a future crime or hide one that is still going on. The privilege protects an honest account of what happened, so your lawyer can advise you properly.
Can I lose the privilege?
The privilege belongs to you, not your lawyer. You can give it up by expressly agreeing to disclosure. You may also lose it if you share the conversation with other people, because it is then no longer confidential. Keep what you discuss with your lawyer between the two of you.
Is a first consultation also confidential?
Section 126 covers what you tell a lawyer in the course of their work for you as your lawyer. Whether a first meeting before you hire the lawyer is covered can depend on the facts, so ask the lawyer to confirm confidentiality at the start. It applies to what you tell the lawyer, not to an enquiry sent to a referral service beforehand.
What happens if a lawyer breaks confidentiality?
A lawyer who breaches client confidentiality faces disciplinary proceedings under the Legal Profession Act 1976. The Advocates and Solicitors Disciplinary Board can impose penalties including suspension or striking off the roll. Keeping client confidences is a basic duty of every lawyer.
Does privilege apply if I have not paid the lawyer yet?
Section 126 does not mention payment. The test is whether you told the lawyer something in the course of their work for you as your lawyer. If you are unsure whether an early meeting is covered, ask the lawyer to confirm at the start.
