Your right to a lawyer

Article 5(3) of the Federal Constitution says an arrested person may consult and be defended by a lawyer of their choice. [f1] That right starts at arrest. Before that, nothing stops you asking a lawyer for advice at any time.

You can take legal advice before replying to the bank, before a police interview and at any court hearing. After an arrest, police must allow reasonable time to consult a lawyer before questioning. A lawyer has no general right to sit in during the interview.

If you do not have a lawyer yet, our guide to finding legal help explains how to find one who handles frozen account and AMLA cases. Acting early protects your position.

Equal treatment under Article 8

Article 8 of the Federal Constitution guarantees that everyone is equal before the law and equally protected by it. [f3] A freeze must follow the same rules whoever you are, whatever your background, and however much is in your account.

So the authority that froze your account must have lawful grounds. It cannot freeze accounts at random or single people out. If you think your account was frozen without proper grounds, this right supports a challenge.

You also have the same access to legal remedies as anyone else. The application to unfreeze an account is open to every account holder, and the court must judge your case on its facts.

Your right to know who froze your account

You are entitled to ask which authority ordered the freeze and why. [f4] Without this, you cannot take the right legal steps.

Your bank may be able to give you the freeze order’s reference number and the name of the authority. It may be the Royal Malaysia Police, the Public Prosecutor, Bank Negara Malaysia or a court. Each follows a different process, so this decides your next steps.

Pass this to your lawyer, who can make formal enquiries and prepare your response. Our guide on how account freezes work shows what to expect.

Money for living costs under AMLA section 44A

If an enforcement agency froze your account under AMLA section 44, you can apply in writing to that agency to vary the freeze so that money is released for basic living costs. [f2] The law accepts that a freeze should not leave you and your family with nothing to live on.

A section 44A application can cover rent or home loan payments, food, medical costs, school fees and utility bills. Your lawyer prepares it with papers showing your monthly costs and that you have no other income.

If the senior officer accepts the costs are real and necessary, the freeze is varied to release that amount. The rest of your money stays frozen. Apply early, because the decision takes time and your bills do not wait.

Your right to judicial review

Every account holder can ask a court to check whether a freeze order was lawfully made. [f5] This is called judicial review. It is a formal case in the High Court, where a judge tests the order against what the law requires.

Grounds include the authority going beyond its powers, not following the correct steps, acting on too little evidence, or acting in bad faith. If the court finds the freeze unlawful, it can cancel the order and direct that your money be released.

Judicial review is separate from any criminal case. You can challenge the freeze even while an investigation continues. Your lawyer files under Order 53 of the Rules of Court 2012, and the court sets a hearing. Our finding legal help guide explains what to look for in a lawyer for this work.

How to use your right to a lawyer

Knowing you have the right is the first step. Using it means getting a lawyer before you do anything else.

  • Speak to a lawyer before you reply to any letter from a bank or authority.
  • Speak to a lawyer before any police interview.
  • Speak to a lawyer before you sign anything.

Your lawyer will look at your situation, tell you what to say and what not to say, and act for you at each step.

If cost is a worry, Malaysia has legal aid through Jabatan Bantuan Guaman and Yayasan Bantuan Guaman Kebangsaan (YBGK). Both offer help in criminal matters, subject to eligibility. Our finding legal help guide explains who qualifies and how to apply.

How to get the details of your freeze order

You can do this today. Call your bank’s customer service and ask for three things: the freeze order reference number, the date the freeze started, and the name and contact details of the authority that ordered it.

Also ask in writing, so there is a record of when you asked. If the bank delays or refuses, your lawyer can send a formal letter demanding the details.

With these details, you know who to write to, which law applies and what deadlines there are. Every later step depends on them, from a living costs application to judicial review.

What happens when you challenge a freeze

Your lawyer first reads the freeze order and the reasons the authority gave. They then pick the strongest ground to challenge it: a procedural error, too little evidence, or a response out of proportion.

There are a few ways to challenge it. A written representation to the authority can be tried first and may settle things without court. If that fails, a judicial review in the High Court puts the matter before a judge. In urgent cases, your lawyer can ask for an early hearing.

Your rights under Articles 5(3) and 8 apply the whole way through. [f1] [f3] The authority must justify the freeze, and the court checks independently whether it meets the law. Our what to do now guide helps you take the steps in the right order.

How long each step takes

No fixed time applies to these steps. Each moves at its own pace.

Application for living costs: your lawyer can prepare it within days. A senior officer of the agency decides, and the agency sets its own pace.

Representation to the authority: a formal letter asks the authority to reconsider or explain. If no reply comes, your lawyer can move to formal legal action.

Judicial review: your lawyer needs time to prepare it. After filing, the High Court sets a hearing date according to its schedule. The decision may come at the hearing or later.

Mistakes that weaken your position

Some steps taken without advice make things harder to fix.

Do not contact the authority yourself without your lawyer. What you say without advice can be used in the investigation and may clash with your case later. Do not sign papers from the bank or police until your lawyer has read them.

Do not withdraw cash from other accounts or move money in ways that could look suspicious. If only one of your accounts is frozen, keep using the others normally. Unusual activity can lead to more freezes.

Do not ignore letters or deadlines. A freeze order may give you a time to respond, and missing it can narrow your options. Act now and let your lawyer handle the timing.

How Malaysian law protects account holders

The Federal Constitution is the top layer. Article 5(3) gives you the right to a lawyer, and Article 8 the right to equal treatment. [f1] [f3]

Below it, AMLA gives specific rights, such as the section 44A application for living costs. [f2] The Rules of Court 2012 set out the procedure for judicial review. [f5]

Together, these mean a freeze order can be challenged. A lawyer who handles these cases can look at your facts and advise the strongest next step. Find the right lawyer to get started.
