If you cannot afford a private lawyer for a mule account or frozen account case, three bodies in Malaysia can help. Each has its own rules on who qualifies, so you may fit one and not another.

The Federal Constitution protects your right to a lawyer. Article 5(3) guarantees that every person may consult and be defended by a lawyer. [f4] Not having money does not remove your right to choose a lawyer. These programmes exist to help with the cost.

Yayasan Bantuan Guaman Kebangsaan (the National Legal Aid Foundation) covers criminal cases at arrest, remand and bail for Malaysians, and at trial and appeal subject to a means test. [f1] It does not cover offences punishable by death. Check ybgk.org.my for the centre nearest you.

Ask YBGK whether it can act in criminal matters such as mule account charges under Sections 424A, 424B and 424C of the Penal Code, or AMLA cases. If you qualify, YBGK may be able to help at low or no cost to you.

To apply, go to the nearest YBGK legal aid centre. Bring your MyKad, proof of household income (payslips, an employer letter or an EPF statement), and any papers about your case, such as bank freeze notices, police letters or court documents.

YBGK staff check whether you qualify. If you do, they assign a lawyer to your case.

Jabatan Bantuan Guaman (the Legal Aid Department) gives legal aid based on a means test under the Legal Aid Act 1971. [f2] [f5] JBG has offices in many parts of the country.

A means test compares your household income with the limit set under the Act. If your income is below it, JBG may be able to help. For criminal cases the main free route is YBGK. Ask JBG whether your mule account or AMLA matter is one it can take, because its coverage depends on the type of case and the court.

Go to a JBG office with your ID, proof of income and case papers. Staff run the means test and decide whether you qualify. Waiting times differ between offices, so apply early, especially if a court date is coming up.

Bar Council pro bono programmes

The Malaysian Bar Council runs pro bono (unpaid) legal help through state bar committees. [f3] These programmes match people who cannot afford a lawyer with volunteer lawyers.

If you do not qualify for YBGK or JBG, for example because your income is just above the limit, a pro bono programme may still be worth asking about.

Contact the Bar Council or your state bar committee directly and explain your situation and your case. The committee looks at your request and tells you whether it can match you with a volunteer lawyer. The Malaysian Bar website lists contact details for each state committee.

What documents to bring

Having your papers ready before you visit a legal aid centre speeds things up. Bring:

ID. Your MyKad, and those of other household members for the income check.

Proof of income. Payslips, an employer letter confirming your salary, EPF statements, or a statutory declaration of income if you are self-employed or not working. Ask the centre how many months it wants.

Case papers. Any bank letters or notices about the freeze, letters from police or other authorities, any court documents, and your own written timeline of what happened. The fuller your file, the faster the lawyer can start.

If police have already contacted you, bring the details: the officer’s name, the date and what was discussed. Your lawyer needs this to plan your defence.

Legal aid through YBGK, JBG and pro bono programmes is meant to pay for the lawyer’s work. Ask each one whether it covers questioning at the police station, court applications (including applications to release frozen funds), bail hearings and defence at trial.

Whether court filing fees are covered depends on the programme. Ask about this when you apply.

Costs outside the lawyer’s work, such as private investigators or expert witnesses, may not be covered.

Apply early

Applications take time to process, and each week without a lawyer is a week in which deadlines can pass.

If your account has been frozen and you cannot afford a private lawyer, go to a YBGK or JBG office this week. If you are not sure which programme fits, the finding legal help guide explains the differences.

Do not wait for a court date to seek legal aid. A lawyer can help from the first police contact onward.

Who qualifies for free legal aid in mule account cases?

YBGK covers criminal cases at arrest, remand and bail for Malaysians, and at trial and appeal subject to a means test. JBG uses a means test on household income under the Legal Aid Act 1971, and you qualify if your income is below the set limit. Ask each one whether it can act in your type of case, including AMLA and mule account charges.

How do I apply for YBGK legal aid?

Go to the nearest YBGK legal aid centre with your MyKad, proof of income (payslips or an employer letter), bank statements and any papers about your case. Staff check whether you qualify. If you do, they assign a lawyer to your case.

Are legal aid lawyers experienced enough for mule account cases?

Legal aid lawyers are qualified lawyers. You cannot always choose who is assigned, so tell the centre it is a criminal case involving a bank account and ask what experience the lawyer has with it.

How long does the legal aid application take?

Processing time differs by office, so we cannot give you a fixed number. Apply as early as you can, because a late lawyer can mean missed deadlines. If you have a court date or a police appointment coming, say so when you apply.

Can I get legal aid if I already have a job?

Yes. Having a job does not rule you out. What counts is your total household income, measured against the limit set under the Legal Aid Act. If it is within the limit, you can get legal aid while working.

What does free legal aid cover in a mule account case?

It is meant to cover the lawyer's own work, which can include the police station, court applications, bail and defence at trial. Costs outside that work, such as private investigators or expert witnesses, may not be covered. Ask the centre exactly what is included in your case.
