Bail for Mule Account Charges
Mule account offences are bailable, and you can apply for release.

Do you have a right to bail?
Yes. If you are charged with a mule account offence, bail is your legal right. [f1] CPC Section 387 says a person accused of a bailable offence shall be released on bail.
All three mule account charges, Sections 424A, 424B and 424C of the Penal Code, are bailable offences. [f3]
So you do not have to prove you deserve bail. The court or the police set the amount and conditions.
Bailable and non-bailable offences
For bail, Malaysian law sorts offences into two groups. A bailable offence gives you a right to bail under CPC Section 387. [f1] For a non-bailable offence, the court decides under CPC Section 388 whether to allow bail. [f2]
Mule account charges are bailable. The court or the police still set the amount and conditions, but whether you get bail is not up to their choice.
Some other offences that can be charged alongside them may be non-bailable, so ask your lawyer about each one. If you face more than one charge, your lawyer deals with bail for each charge separately.
What happens at the bail hearing
Bail can be dealt with at your first court date, called the mention. The charge is read out and you are asked how you plead. Your lawyer then applies for bail.
The court weighs several things when setting the amount. [f4] These include how serious the charge is, the money involved, your job, your family ties and any past criminal record.
The aim is an amount that makes sure you come back to court, not one that punishes you.
Your lawyer can hand in supporting papers: a letter from your employer, proof of address and proof of your ties to the community. If you were arrested recently, a lawyer can get these ready before the hearing.
How much bail and what affects it
Bail amounts vary. A Section 424A charge carries the lightest penalties (a fine of RM5,000 to RM50,000 or six months to five years in jail), so bail can be lower. [f3] Sections 424B and 424C carry heavier penalties, so bail may be higher.
The Magistrate also looks at how much money passed through the account. Larger sums can mean higher bail.
Your own background counts too. Someone with a steady job, a family and no record can get lower bail than someone who has missed court before.
No law fixes the amount. It is set case by case, which is why your lawyer’s preparation and argument can change the figure.
Paying bail: cash or a surety
You can meet bail in two ways. You can pay a cash deposit to the court. Or a surety can sign for you: a person who promises to pay the amount if you fail to turn up.
A surety can be a family member or close friend who can show they have the money to cover it. They sign a bond and are liable if you break your bail conditions.
Your family members can act as sureties. They should bring their identity card and proof of income to court.
Once bail is paid, the court processes your release. You get a bail bond document that lists your conditions.
If bail is too high
You have options. [f5] CPC Section 389 lets you apply to lower the bail. Your lawyer shows the court your finances and explains why the amount is more than you can pay.
The court may lower the amount or accept other arrangements, such as a surety bond instead of cash. Several family members can stand as sureties together to meet a higher figure.
Do not assume bail is out of reach before you speak to a lawyer. The court must set bail to secure your attendance, not to punish you. Finding a lawyer who handles these cases early gives you a better chance of bail you can afford.
What conditions come with bail?
Bail conditions can include:
- handing your passport to the court;
- reporting to the nearest police station on set dates;
- not leaving the country without the court’s permission.
You may also be told not to contact prosecution witnesses or co-accused.
Breaking any condition is serious. The court can cancel your bail, issue an arrest warrant, and you lose the bail money. If you are unsure about a condition, ask your lawyer.
After you are released
Your focus now is your defence. The investigation and court process continues, and you must attend every court date. Missing even one can lead to a warrant and re-arrest.
Between hearings, your lawyer reviews the prosecution’s evidence, gathers documents for your side and plans the defence. If your bank account is still frozen, your lawyer can take that up with the authorities too.
Bail does not end the case. It means you prepare your defence from home rather than from remand.
