Is bail a right in a mule-account case?
Sections 424A, 424B and 424C of the Penal Code are bailable offences, so bail is a right. The court or the police set the amount and the conditions, and no one can promise you a particular figure.
Factor one: how serious the alleged offence is
A more serious charge can carry more weight when the amount and conditions are set. The mule-account offences differ in severity, so which one is alleged matters.
At the lower end, section 424A (having or controlling someone else’s account without lawful authority) carries a fine of RM5,000 to RM50,000, or 6 months to 5 years in jail, or both [f1]. Section 424C (making transactions through an account without a lawful purpose) is the most serious of the three. It carries a fine of RM10,000 to RM150,000, or 3 to 10 years in jail, or both [f2].
Factor two: your ties to the community
The court or police look at whether you are likely to attend future hearings. A fixed home address, steady work and family responsibilities all show stability.
Gather proof ahead of time: a tenancy agreement or utility bill, an employment letter and your identity documents. Having them ready means you are not scrambling on the day.
Factor three: cooperation and record
How you have dealt with the investigation can matter. The CCID at Bukit Aman investigates mule-account cases, and a record of orderly cooperation, kept in your contact log, can show good faith [f4].
A clean prior record can also be considered. None of this guarantees anything.
Factor four: the conditions that may apply
Bail can come with conditions, such as a bail sum, a surety (someone who guarantees you will attend court) or regular reporting to the police. Think ahead about who could act as surety and which conditions you can realistically meet.
Your lawyer can suggest suitable conditions to the court. Having names and documents ready makes that quicker.
How to prepare
Start by finding out which section may apply, using our section identifier. Collect proof of your address, work and family ties, and keep your contact log up to date.
Above all, get legal advice. Article 5(3) of the Federal Constitution gives an arrested person the right to consult a lawyer of their choice [f3]. A lawyer cannot promise an amount, but can put your position across clearly and honestly. If you want to speak to one, send us a WhatsApp message.

Is bail a right in a mule-account case?
Yes. Penal Code sections 424A, 424B and 424C are bailable offences, so bail is a right. The court or the police set the amount and the conditions. No one can promise you a particular amount, so be careful with anyone who does.
Does the seriousness of the charge affect bail?
It can affect the amount and the conditions, because a heavier penalty can bring a higher bail sum or stricter terms. The three sections carry different penalties, so which one is alleged can matter. A lawyer can explain how your situation is likely to be viewed.
What personal factors matter?
The court or police can look at ties to the community, such as a fixed address, steady work and family duties. A clean record and cooperation with the investigation can also matter. These show you will attend court. Gathering proof of them in advance is a useful step.
Should I have a lawyer when bail is set?
Yes, it is strongly advisable. You have the right to a lawyer, who can put forward the relevant factors, suggest suitable conditions and answer the prosecution. Facing this alone and under stress makes it harder to explain your position. Early advice also helps you prepare the right documents.
