How long a freeze lasts depends on who froze your account

There is no single answer to how long a bank account stays frozen in Malaysia. It depends on which authority froze it and under which law. A police freeze follows different rules from a Public Prosecutor’s order or a hold by your bank’s compliance team.

Knowing which type of freeze you are facing is the first step in planning what to do next. For an overview of all freeze types, see our guide to understanding account freezes.

AMLA freeze: 90 days, then up to 18 months

An enforcement agency such as the police can freeze your account under Section 44 of the Anti-Money Laundering Act (AMLA). It ends after 90 days unless you are charged. The Public Prosecutor can also order a bank not to release the money under Section 50.

Section 52A of AMLA sets a cap on seizure orders: they lapse 18 months from the order date, or from an earlier freezing order, if no one is charged or no prosecution is started. [f1] The limit was 12 months until an amendment took effect on 1 March 2026.

There is one exception. If the Public Prosecutor applies for forfeiture before the deadline, the money can stay restrained until the High Court decides.

Courts have enforced this kind of deadline. In Lim Hui Jin v CIMB Bank Bhd [2018], decided under the earlier 12-month limit, the Court of Appeal ordered funds released after a seizure order ran past its deadline without a charge. [f5]

Police freeze: also 18 months

Police officers of Sergeant rank or above can freeze accounts under Section 116D of the Criminal Procedure Code (CPC). This power was added in 2024 and lets police act at once, without a court order.

A Section 116D freeze lapses after 18 months if no prosecution is started. [f2] Until then it stays in place while the investigation goes on. A Sessions Court can vary or revoke it on application, for example to release money for reasonable living costs.

If you are facing a police freeze, knowing your options for applying to unfreeze lets you act instead of only waiting.

Bank compliance hold: no fixed period

Your bank can put a temporary hold on your account through its own compliance checks. This happens when its monitoring flags unusual activity, such as sudden large transfers or a pattern that does not fit your account. [f3]

No legal time limit applies to these holds. They last while the compliance team reviews the flagged transactions, and the bank may contact you to check them.

If the review clears the activity, the hold is lifted and your account goes back to normal. If the bank finds a real concern, it may report the matter to the authorities. The hold can then become a formal freeze order under AMLA or the CPC, and that order’s time limits apply instead.

Court garnishee order: until the debt is paid

A garnishee order is a court order that freezes money in your account to pay a debt you owe a creditor. It is a civil process, separate from criminal freezes.

A garnishee order stays in force until the debt is paid in full or the court discharges it. [f4] There is no fixed time limit. How long it lasts depends on how much you owe and whether you agree a repayment plan with the creditor.

A garnishee order goes through the civil courts. A lawyer who handles civil debt matters can advise on your options, including applying to vary or discharge the order.

Freeze time limits at a glance

AMLA freeze (Section 44): up to 90 days unless you are charged.

AMLA seizure or Public Prosecutor order: lapses if no one is charged within 18 months. The Public Prosecutor can apply for forfeiture before then.

Police freeze (CPC s116D): Lapses after 18 months if no prosecution is started. A Sessions Court can vary or revoke it earlier.

Bank compliance hold: No fixed period. A formal freeze may replace it if the bank reports the matter.

Court garnishee: Until the debt is paid in full or the court discharges the order. No fixed time limit.

What affects how long your freeze lasts

Whatever the type, a few things affect how long a freeze actually lasts.

How complex the investigation is matters most. A simple case with one flagged transaction may end sooner than one involving many accounts or transfers across borders.

How you answer investigators matters too. Gaps in your records or unanswered questions can slow an investigation, while clear documents leave the investigating officer less to chase.

Getting advice early helps you avoid mistakes and use the applications open to you. A lawyer who handles frozen account matters can deal with the authority involved and file applications for you. No one can promise a date.

What the Lim Hui Jin v CIMB [2018] case shows

In this Court of Appeal case, funds were ordered released because a seizure order had run past the legal deadline without a charge. [f5] It was decided under the 12-month limit that applied then.

The point still holds: the freeze has an outer limit, and courts enforce it. The figure to watch today is 18 months, the limit in force since 1 March 2026.

What you can do while waiting

You still have steps you can take to protect your position during a freeze.

Keep your financial records in order. Bank statements, tax filings, job letters and records of where your money came from all help prove your money is legitimate. The evidence preparation guide explains what to collect.

If you need money for basic living costs, apply to vary the freeze. For an AMLA freeze, Section 44A lets you apply in writing to the enforcement agency that issued it. For a police freeze under CPC Section 116D, the application goes to a Sessions Court.

Stay in touch with your lawyer and reply to everything from investigators or the bank. Each reply you give on time helps move things along.

When to get a lawyer

If your account has been frozen for more than two weeks and no one has told you clearly why or for how long, speak to a lawyer.

A lawyer can find out which authority issued the freeze, explain the rules for that type of freeze, and file the right applications for you. For help choosing a lawyer, see our guide to finding legal help.

You do not need all the answers before you get in touch. A short description of your situation is enough for a lawyer to tell you where you stand.

What is the maximum time a bank account can be frozen under AMLA?

An AMLA Section 44 freeze by an enforcement agency lasts up to 90 days unless you are charged. A later seizure or Public Prosecutor order under Section 52A lapses if no charge is filed within 18 months of the order, or of an earlier freezing order.

Is there a time limit on a police freeze under CPC Section 116D?

Yes. A police freeze under Section 116D lapses after 18 months if no prosecution is started. [f2] Before then, a Sessions Court can vary or revoke it on application, for example to release money for reasonable living costs.

How long do bank compliance holds last?

There is no fixed period. A hold the bank places itself lasts while it reviews the flagged activity under its anti-money laundering duties. [f3] If the bank finds no problem, the hold is removed. If it reports the matter to the authorities, a formal freeze order with its own time limit may replace the hold.

When does a court garnishee order end?

A garnishee order stays in force until the debt is paid in full or the court discharges it. This is a civil matter, not a criminal one, so how long it lasts depends on the amount owed and any repayment arrangement.

Can a freeze be extended beyond 18 months?

Section 52A has no way to extend the period. The main exception is forfeiture: if the Public Prosecutor applies to the High Court for forfeiture before the deadline, the money can stay restrained until the court decides.

What can I do while a freeze is in place?

Answer investigators through the proper channels, keep your documents in order, and ask a lawyer whether an application to release money for living costs fits your case. None of this guarantees a faster result, but gaps in your records can slow things down.

Does the Lim Hui Jin case mean my freeze must end at 18 months?

The case was decided in 2018 under the earlier 12-month limit, when the Court of Appeal ordered funds released after a seizure order ran past that deadline without a charge. [f5] The limit has been 18 months since 1 March 2026, so that is the figure to watch today. Whether it applies to you depends on which order froze your account.
