What happens when your account is frozen in George Town

George Town is the capital of Penang, and the Penang High Court sits there. If your account is frozen and you bank on the island or the mainland, the court that may decide your case is in the city.

The freeze rules come from national law, not Penang law. What is local is the George Town courts, the Penang investigators and the legal aid you can reach nearby.

If this is all new to you, start with how account freezes work.

Which laws are used to freeze an account?

The usual freeze power is AMLA 2001 section 50. It lets the Public Prosecutor freeze an account suspected of holding money from crime [f1]. Under the 2024 amendments, a police officer of Sergeant rank or above can also freeze an account under Criminal Procedure Code section 116D, without a court order.

If the police suspect a mule account, the Penal Code applies. That includes section 424A, which covers holding or controlling someone else’s account without lawful authority [f4].

Which court decides your case?

The judiciary lists Pulau Pinang among High Court locations under George Town. [f6] The prosecution decides whether a charge is heard in the Magistrates’ Court or the Sessions Court, so read the court off your notice or charge sheet.

Two protections matter under an AMLA freeze. You can apply under section 44A to release money for reasonable living or business costs [f2]. That application goes in writing to the agency that froze the account, not to a court.

Section 52A also makes that order lapse after 18 months if the person is not charged [f3]. If you are unsure which law froze your account, a lawyer can find out and prepare the right application.

If the police call you in George Town

You may be asked to attend a police station, possibly the district police headquarters (IPD) that covers you. Which IPD covers George Town is not something we have confirmed, so ask for the station name and time in writing.

The state police contingent (IPK) is on Jalan Penang. [f7] The Commercial Crime Investigation Department (JSJK) is a national police department.

Get advice before you go. What you say early can shape the whole file, and you can ask to speak to a lawyer first.

The Bar Council Legal Aid Centre for Penang is at Greenhall, and the Penang Bar Committee is the Malaysian Bar’s local body. [f8]

The Legal Aid Department (Jabatan Bantuan Guaman) office in Penang helps people within its income limits. [f5]

If you later need a private lawyer, finding legal help explains what to look for.

What to do next

Leave the account alone. Do not contact the investigating officer before you get advice. Gather the freeze reference number and any letters.

Then have a lawyer look at your case.

Which court hears a George Town frozen-account case?

George Town is the Penang state capital, and the High Court for Penang sits there. The prosecution decides whether a charge is heard in the Magistrates' Court or the Sessions Court.

What if the police ask me to come in?

Check the letter or call for the station name, date and time. It may be the district police headquarters (IPD) that covers you, and we have not confirmed which IPD covers George Town. Take advice before you go.

Can I release money for daily costs during a Penang freeze?

You can apply. If an enforcement agency froze the account under AMLA, section 44A lets you apply in writing to that agency to release money for reasonable living or business costs. A more senior officer decides. A lawyer can set out your real needs and attach the documents so the request is complete.

How long can a George Town freeze last?

A Public Prosecutor's AMLA order lapses if the person is not charged within 18 months under section 52A. A police freeze under Criminal Procedure Code section 116D lapses after 18 months if no charge is brought. A lawyer can track these deadlines and challenge a freeze that runs past them.

Where is the Bar Council Legal Aid Centre in Penang?

The Bar Council Legal Aid Centre for Penang is at Greenhall. The Legal Aid Department also lists a Penang office. Either can explain your position before you decide on a private lawyer.
