When a George Town account holder hears “mule account”

You have just learned your account is being investigated as a mule account in George Town. Your first thought is probably that you did nothing wrong.

Perhaps you only lent your card, shared your PIN, or let a friend use your account for a while. That may well be true. But the law does not treat a favour as harmless by default, so this is the time to act carefully.

Lending a card is not a defence on its own

Handing over your card or account is exactly what the mule offences describe. Giving someone else control of your own account without lawful authority or purpose is an offence under the Penal Code [f2]. Possessing or controlling someone else’s account is a separate offence [f1].

These rules are federal, so they apply the same way across Malaysia. What you knew and why you did it matter to your defence. A lawyer can help you set that out honestly.

Statement and first mention

You may be asked to give a statement at a police station, possibly the district police headquarters (IPD) covering you. The state police contingent (IPK) is on Jalan Penang. [f6]

If you are charged, the first mention is at the court named in the charge sheet or summons. The prosecution decides whether it is the Sessions Court or the Magistrates’ Court, and the Penang High Court is listed under George Town. [f7]

The Commercial Crime Investigation Department is a national police department. [f4] Your account may have been flagged after a victim’s report, and it may show on the PDRM Semak Mule portal. [f3]

Turning an honest story into evidence

An honest story is not yet a proven one. Your friend’s messages asking for help, the dates, and your bank statements are what an investigator can actually weigh.

A lawyer helps you collect these and present them clearly before you give a statement. Under Article 5(3) of the Federal Constitution, an arrested person has the right to a lawyer of their choice [f5], and you can seek a lawyer’s advice before any police interview. Read more about your account holder rights.

If you cannot afford a lawyer, the Legal Aid Department (Jabatan Bantuan Guaman) has a Penang office for people whose income qualifies. The Bar Council Legal Aid Centre for Penang is at Greenhall. [f8]

For more background, see the Penang page and the section 424A explainer.

What to send first

You do not need to prove your innocence in one message. A few lines on how your card was used, by whom, and when are enough for a lawyer to explain your options.

I only lent my card to a friend. Surely I am innocent?

You may be. Lending your card or PIN can still fall under Penal Code section 424B, which covers giving control of your own account to someone else. Your defence rests on the honest detail of what you knew, and a lawyer helps you put that on record.

Where might the police ask me to attend?

The call or letter should name the station. It may be a district police headquarters (IPD) under the Pulau Pinang contingent on Jalan Penang, and we have not confirmed which IPD covers George Town. Take advice before you go.

How did my account get flagged in the first place?

A scam victim may report a loss, and the money is traced to your account. The account can then appear on the PDRM Semak Mule portal, where more than 190,000 accounts have been listed. A flag means an investigation, not a conviction.

Can I just explain to the police that I was helping a friend?

You can, but prepare first. Under Article 5(3) of the Federal Constitution an arrested person has the right to consult a lawyer of their choice. A casual explanation given without preparation can read like an admission once it is written down.

What is the difference between the sections I might face?

Section 424A covers possessing or controlling someone else's account. Section 424B covers giving control of your own account to someone else. How your card was actually used decides which one fits.
