What happens when your salary account is frozen

When the account your salary goes into is frozen, every transaction on it is blocked. Your employer can still pay money in, but you cannot withdraw, transfer or use it. Your salary is not lost; it builds up inside the frozen account.

For a working person this is very stressful. The bills keep coming, your family still needs to eat, and the money you earned is out of reach. Malaysian law does give you ways to deal with this.

If you are not sure why your account was frozen, start with our guide to understanding account freezes. It explains who can freeze an account and why.

Your employer still pays you

A freeze order targets your bank account. It does not change your employment contract or your employer’s duty to pay you. Payroll may run on schedule and your wages may be paid in as usual.

The money simply sits in the account where you cannot touch it. Your job and your pay cycle are not affected.

Your EPF (KWSP) contributions also carry on as normal. [f4] Both your share and your employer’s share go into your EPF account. The freeze affects your bank account only, not your retirement savings.

Can your employer pay into a different account?

You can ask your employer to pay your salary into another bank account that is not frozen. This is a voluntary arrangement between you and your employer. [f3] The police cannot force your employer to change where your salary goes.

Some employers will help once you explain. Give them the details of an account in your own name at a different bank, if you have one, and ask them to update your payroll records. Avoid having your salary paid into someone else’s account: money moving through another person’s account is one of the patterns banks watch for.

If your employer agrees, you can use your future salary straight away while the freeze on your old account is dealt with. Keep a written record of the arrangement.

Applying to vary the freeze order

If your salary cannot be paid elsewhere, or you need money already in the frozen account, AMLA Section 44A gives you a legal route. [f1] If an enforcement agency froze the account under Section 44, you can apply in writing to that agency to vary the freeze order.

A variation does not end the freeze. It lets the agency release set amounts for essential living costs. These can include rent or mortgage payments, utility bills, food, medical costs, children’s school fees and loan repayments.

Your lawyer prepares the application with supporting documents: payslips, a list of monthly expenses, proof of dependants and any other proof of need. A more senior officer reviews it and can direct the bank to release a fixed amount each month. We have a separate guide on finding the right lawyer.

The 18-month freeze limit

Under Section 52A, an AMLA freeze order lapses if the authorities do not charge you within 18 months. [f2]

So if no one is charged, the order has a clear end point. If you are charged, the position changes, and your lawyer can explain what that means for the account.

What to do straight away

The first few days after you find your salary account frozen matter most. Here is what to do.

Contact your bank. Confirm the freeze, ask which authority ordered it and get any reference numbers. Write down the date, the bank officer’s name and exactly what you were told.

Talk to your employer. Explain that your account is frozen and ask whether your salary can go to another account. Do this quickly so your next pay is not affected.

Gather your financial documents. Collect the last 12 months of bank statements, payslips, your employment contract and any letters from the bank or the authorities. These support a variation application and any investigation.

Do not try to move frozen money. Trying to get around a freeze order can cause new legal problems. Never move money out of the frozen account, and never use someone else’s account.

Contact a lawyer. The sooner you get advice, the sooner a variation application can be filed. Our guide on what to do now has the full list of first steps.

How a lawyer helps with a variation application

A Section 44A variation application is a written application to the enforcement agency, with no court filing. A lawyer who handles AMLA cases can run the whole process for you.

Your lawyer collects your financial evidence, works out your essential monthly costs and drafts the application. They then explain to the senior officer why you and your dependants need part of the money released to cover basic living costs.

The agency may allow a fixed monthly amount from the frozen account, or allow specific payments such as rent paid straight to your landlord. The exact terms depend on your situation and the senior officer’s view.

Getting the application right the first time matters. A poorly prepared application can be rejected, which causes more delay. A lawyer who has done these before knows what evidence the agency expects and how to present it.

You are not the only one

A frozen account does not by itself mean you did something wrong. The law lets people ask for money to live on, which is why Section 44A exists.

Your employer’s help, a variation application and the 18-month limit together give you a way through this. The steps you take now matter.

If you want to discuss your situation with a lawyer, a short WhatsApp message is enough to start.

Can my employer still pay my salary if my bank account is frozen?

Yes. A freeze order covers your bank account, not your employer's duty to pay you. Payroll may carry on as normal. Your salary goes into the frozen account, but you cannot take it out until the freeze is lifted or varied.

Can I ask my employer to pay into a different account?

You can ask. Your employer does not have to agree, and the police cannot force them to pay your salary elsewhere. But some employers will help if you explain the situation and give them another valid account.

How do I apply for a variation to cover living expenses?

Under AMLA Section 44A, you or your lawyer apply in writing to the enforcement agency that froze the account to vary the freeze order. The application sets out your monthly expenses, dependants and financial commitments. A more senior officer decides and can release part of the money for rent, food, utilities and other essentials.

Does my EPF contribution stop when my account is frozen?

No. Your EPF (KWSP) contributions carry on despite the freeze. Both your share and your employer's share still go into your EPF account. The freeze affects your bank account only.

How long will my salary account stay frozen?

Under AMLA Section 52A, a freeze order lapses if no one is charged within 18 months.

Do I need a lawyer to apply for a variation order?

The application is made in writing to the enforcement agency and follows set legal steps. The law does not require a lawyer, but one who handles AMLA cases can prepare the application properly and present the evidence clearly.

What happens to salary that was deposited while my account was frozen?

It stays in the account while the freeze lasts. If the freeze is lifted or varied, you can use the money, including the salary paid in during the freeze.
