Joint Account Frozen? Your Rights as Co-Holder
When one holder triggers a freeze, every name on the account is affected.

What happens when a joint account is frozen?
A freeze order on a joint bank account covers the whole account [f1]. It does not matter who put the money in or which holder is being investigated. Everyone named on the account loses access to all of it.
So if you share an account with a spouse, relative or business partner, their legal trouble can lock you out of your own money. The freeze stays until it is lifted, varied, or runs out under the legal time limit.
If you are not sure what a freeze order is or who can make one, read our guide to account freezes.
Why can’t the bank release your money?
The law requires your bank to obey the freeze order [f3]. Even if you can prove every ringgit was yours, the bank cannot pay you unless the freeze is formally varied or revoked, or lapses.
This is not the bank’s choice. The freeze is a legal instruction from an enforcement agency, the Public Prosecutor or the police, and the bank cannot set it aside.
Calling or visiting the bank will not change this. The answer lies in the legal process, starting with your rights as an account holder.
Can you ask for a variation?
Yes. For a freeze by an enforcement agency under AMLA section 44, section 44A lets anyone affected apply in writing to that agency for a variation [f2]. A variation is a change to the order, such as releasing some money. As a co-holder, you can apply even though you are not the one being investigated.
A variation asks for set amounts to be released for essential living costs. These can include rent, utilities, food, medical bills and children’s school fees. How much is released depends on the needs you can show with documents.
A lawyer can prepare the application using your pay slips, expense records and proof of anyone who depends on you. To find a suitable lawyer, see our guide to finding legal help.
How do you show which money is yours?
An important step is proving which money in the account is yours [f4]. This is called fund tracing: building a clear record of what you paid in and what the other holder paid in.
Gather your salary records, transfer confirmations and any other proof of your deposits into the joint account. The aim is to show that part of the frozen balance belongs to you and has nothing to do with the investigation.
This matters most if you put in most of the money. A lawyer who handles AMLA cases can advise on the clearest way to present it.
Why do you need your own lawyer?
Your interests and the other holder’s are not the same [f5]. They may face criminal charges, while you need to protect your money and your name. Sharing one lawyer can create a conflict.
Your own lawyer can focus only on your position as the innocent co-holder. They can make the variation application for you, deal with the investigating agency and protect your rights.
If you are worried about cost, you can describe your situation by WhatsApp first and be referred to a lawyer before deciding anything. See our guide to finding legal help for more.
What should you do right now?
Contact your bank. Confirm the freeze, ask which authority made the order and get any reference numbers. Note the date and the name of the person you spoke to.
Gather your financial records. Collect statements, pay slips and transfer records showing what you paid into the joint account over the past 12 months.
Do not try to move money. Trying to transfer money out of a frozen account can cause you more legal trouble.
Get your own lawyer. Explain that you are the co-holder of a frozen joint account and the investigation is about the other holder. Our guide on what to do now lists all the first steps.
What happens next?
Your lawyer sends the written variation application to the agency under section 44A, with your deposit records and monthly expenses. If a senior officer of the agency accepts it, the bank is told to release a fixed amount for your living costs.
The freeze also has time limits. Under AMLA section 44, a freeze by an enforcement agency lasts up to 90 days unless someone is charged. A later seizure order under section 52A lapses after 18 months if no one is charged, and a lawyer can then ask the bank to release the money.
Clear records of what you paid in make your application easier for the agency to assess.

Can a joint account be frozen because of one holder?
Yes. A freeze covers the whole account, not one holder. If one holder is investigated, all the money in the account is frozen, whoever put it in. Every holder loses access until the freeze is lifted or varied.
What can I do as the innocent co-holder?
If an enforcement agency froze the account under AMLA section 44, you can apply in writing to that agency under section 44A, asking for money to be released for essential living costs. You should also gather proof of which money in the account is yours.
Do I need my own lawyer, or can I share one with the other holder?
Get your own lawyer. As the innocent co-holder, your interests may clash with those of the holder under investigation. A separate lawyer looks after your side only.
Can the bank tell me why the account was frozen?
The bank can confirm the account is frozen and which authority made the order. It may not be able to tell you about the investigation. Knowing the authority tells your lawyer which process to use for a variation.
How do I prove which money in the account is mine?
Gather bank statements, salary credit records, transfer receipts and anything else showing what you paid in. A clear trail of your deposits helps show that certain funds are yours, not the other holder's.
Will the freeze affect my other accounts?
A freeze order names specific accounts. Your own accounts, at the same bank or another, are not frozen just because the joint account is. If the investigation later turns to you personally, more freeze orders could follow.
