How to Apply to Unfreeze Your Account
A variation application can release funds for your daily needs while the case continues.

What does a variation application do?
When your bank account is frozen under AMLA section 44, you can still ask the enforcement agency that froze it to let you use part of your money. Section 44A of the Anti-Money Laundering Act allows a more senior officer of that agency to vary (change) the freeze order so you can use money for living costs. [f1]
This does not lift the freeze. The agency can allow money for rent, food, utilities, school fees and medical costs, and the rest stays frozen.
Article 13 of the Federal Constitution protects property rights, so a clear, well-documented request for your own living costs is a fair one to make. [f3]
Who can apply?
Anyone whose money is frozen by an enforcement agency under AMLA section 44 can apply under Section 44A, whether an individual or a business owner.
If the police froze your account under CPC Section 116D, and not an enforcement agency under AMLA section 44, the route is different. [f5] For a police freeze, you apply to the Sessions Court under CPC Section 116D, not in writing to the enforcement agency under AMLA Section 44A.
A police freeze also lapses after 18 months if no charge is brought. Confirm the legal basis of your freeze before you apply. Your rights as an account holder include knowing who ordered the freeze and under which law.
Documents to prepare
Collect these before you meet your lawyer. It saves time and makes the application stronger.
Proof of monthly costs: your tenancy or mortgage agreement, utility bills (electricity, water, internet), grocery receipts, school fee invoices, insurance notices and loan repayment schedules. The agency wants to see real costs that repeat every month.
Proof of income or work: your employment letter, recent pay slips or business registration. If you are self-employed, add invoices, contracts or tax returns that show your income.
Bank statements: at least three months of statements for the frozen account and any other account you have. They show your finances and the transactions in question.
Medical records: if you or someone who depends on you has ongoing medical needs, add doctor’s letters, prescriptions or hospital bills.
Identity: your MyKad or passport, and any reference numbers from the freeze notice. The evidence preparation guide shows how to organise your records.
How the application is made
You make a written application to the enforcement agency that issued the freeze. [f2] Your lawyer can draft it. The letter sets out your circumstances, your monthly costs, the amount you are asking for and why you need it, with your documents attached.
A more senior officer in that agency decides. No court is involved. The officer can vary the order (for example to allow payment of reasonable living costs), revoke it, or refuse. Your lawyer handles the letter, keeps proof that it was delivered and follows up with the agency.
What happens after you apply?
The senior officer reads your application and your documents. The officer looks at how hard things are for you financially, whether your costs are genuine and reasonable, and whether releasing money would harm the investigation.
If the officer agrees, the agency varies the order and tells your bank how much may be used and for what. If the officer refuses, your lawyer can advise you on the next step.
How long does it take?
The law sets no fixed time for a decision, and no lawyer can promise one. In an emergency, such as rent or school fees falling due, say so clearly in the application and ask your lawyer to follow it up with the agency.
Once the agency varies the order, your bank has to act on it. Your lawyer can check that the bank has received the new order and acted on it.
What if the freeze simply runs out?
Not every frozen account needs a variation application. Under AMLA Section 52A, an order lapses if the person is not charged within 18 months. [f4]
A section 44 freezing order itself ceases after 90 days if you have not been charged, although a later order under section 50 can follow it. [f6] If a deadline is near and you have not been charged, your lawyer can track it and write to the bank once the order has lapsed.
A variation gives you money during the freeze, while the 18-month limit is a separate protection. See how long freezes last to plan your next step.
Getting the right legal help
A Section 44A application is decided by a senior officer at the agency, not a court. A clear list of your costs and a well-set-out application help the officer decide. A lawyer who handles AMLA cases can help you prepare both.
If you do not have a lawyer yet, the finding legal help guide explains what to look for. If cost worries you, ask about fees at the start.
Start with a short message describing your freeze. A lawyer can then confirm whether Section 44A applies, what to prepare and how long it may take.

What is a Section 44A variation application?
It is a written application under the Anti-Money Laundering Act asking the enforcement agency that froze your account to change its order. It does not lift the freeze. It can release money so you can pay rent, food, medical care and other reasonable living costs while the investigation continues.
How long does the Section 44A application take?
The law sets no fixed time, and no one can promise one. After you apply in writing, a more senior officer at the agency decides. If you urgently need money, say so in the application and ask your lawyer to follow it up with the agency.
What documents do I need for the application?
Proof of monthly costs such as your tenancy agreement and utility bills, recent bank statements, proof of income or work, medical records if relevant, and your identity documents. Your lawyer can turn these into a clear written application for the agency.
Can I file the application without a lawyer?
You can write to the agency yourself. A lawyer who handles AMLA cases can help you set out your needs clearly and prepare for what the agency may ask about.
Does a variation application mean the freeze is lifted?
No. The agency may let you use some of the money for living costs. The rest stays frozen until the investigation ends, the charges are decided, or the order lapses under Section 52A. It gives you money to live on while the freeze continues.
