How to Get Your Account Unfrozen
How your freeze is lifted depends on who ordered it and which legal route applies.

Why there is more than one way to unfreeze an account
In Malaysia there is no single process for unfreezing a bank account. The right route depends on who ordered the freeze and which law they used. [f5]
Choosing the right route first saves time and stops you filing the wrong application. Below are the steps for each type of freeze.
Step 1: Find out who froze your account
Start by calling your bank. Ask which authority ordered the freeze, which section of the law it used, and any reference numbers.
There are several possible sources:
- an enforcement agency such as the police, under AMLA Section 44
- the police, under CPC Section 116D
- the Public Prosecutor, under AMLA Section 50
- Bank Negara Malaysia, under its powers as regulator
- a court, through garnishee (debt recovery) or criminal proceedings
Each one is lifted in a different way. If you cannot find out who froze your account, a lawyer experienced in frozen account cases can check for you.
AMLA Section 44A: asking for money for living costs
If an enforcement agency froze your account under AMLA Section 44, Section 44A lets you ask that agency in writing to vary the freeze, meaning change it. [f1] The freeze stays in place, but part of the money can be released for rent, food, medical bills and school fees.
For a freeze by an enforcement agency under Section 44, this is a written application to that agency. It includes papers that show your monthly costs.
This can give relief during an AMLA investigation, because it covers daily needs while the case goes on. See how to prepare the right documents for your application.
AMLA Section 52A: the 18-month limit
Every AMLA order has a time limit. [f2] A Section 44 freeze lasts up to 90 days unless you are charged. A later seizure order lapses if no charge is filed within 18 months, and the freeze then ends.
You do not need to apply for this. Your lawyer can track the date and make sure the bank lets the freeze end.
Read how long freezes last to plan ahead. If the 18-month date for a seizure order is close and there is still no charge, your lawyer can prepare for either result.
Judicial review under Order 53
If a freeze order has no proper legal basis, or the authority went beyond its powers, you can challenge it by judicial review. [f3] This is filed in the High Court under Order 53 of the Rules of Court 2012.
The court checks whether the authority followed the right procedure, whether its reasons were enough, and whether the order went further than needed. A court can set aside an order where the legal basis was weak or the process was flawed.
This route needs detailed legal argument and takes longer than a letter or application. It fits when the freeze should never have been made.
Police freeze under CPC Section 116D
A police freeze under CPC Section 116D also ends after 18 months if no one is charged. A Sessions Court can vary it or release it earlier.
Your lawyer can write to the investigating officer and ask for the freeze to be lifted, especially if you have already helped and given documents. If the police refuse or do not reply, judicial review is still open.
Working with the investigation can help move a police freeze along. [f4] Give your bank statements, explain the transactions and attend interviews with your lawyer. Read what to do in the first hours after you find the freeze.
When the bank itself restricted your account
If the bank put the hold on for its own compliance checks, the process is simpler. No court order is involved, so you do not file any legal application.
Call the bank’s compliance team and ask what triggered the hold and which documents they need. Send your ID, proof of income and an explanation of the flagged transactions. The bank may lift the hold once it is satisfied.
If the bank keeps the hold after you have sent everything, your lawyer can send a formal letter. That takes the matter to the bank’s legal department.
Documents to gather
Every route needs documents. Collect them early so nothing holds you up.
For a Section 44A application:
- proof of monthly costs, such as a tenancy agreement, utility bills and school fees
- proof of income or employment
- medical records, if they apply
- bank statements that show your finances
For judicial review:
- the freeze notice or letter from your bank
- letters between you and the authority
- proof that the money in the account came from a lawful source
- any earlier applications or replies
Your lawyer will tell you which ones apply to you. Use the evidence preparation guide to sort your records.
How long does each route last?
Bank hold: no fixed time; it depends on the bank’s review.
Section 44 freeze: up to 90 days unless you are charged.
Section 44A application: no fixed time; the agency decides.
Police freeze: lapses after 18 months if no one is charged; a Sessions Court can vary it earlier.
Seizure order: lapses after 18 months if no one is charged. No action is needed, but keep track of the date.
Cases with several accounts or large sums can take longer. A lawyer familiar with these procedures can tell you which limit applies to your case.
What a lawyer does to get your account released
A lawyer first finds out who froze the account and under which law. They then choose the route and prepare the application or letters.
They deal with the authority for you, file court papers, attend hearings and track deadlines, including the 18-month AMLA limit. You are told what is happening at each stage.

What is the fastest way to unfreeze a bank account in Malaysia?
It depends on who froze it. If the bank put the hold on, sending its compliance team the documents it asks for may settle it. For a police freeze under CPC Section 116D, a lawyer can apply to the Sessions Court to vary it. For an AMLA Section 44 freeze, a lawyer can apply in writing to the enforcement agency under Section 44A to release money for living costs while the investigation goes on.
Can I unfreeze my account without a lawyer?
You can try to clear a hold that the bank itself placed. Police and AMLA freezes involve formal applications, legal arguments and strict procedure. A lawyer who knows AMLA work can tell you which route fits and prepare the papers properly.
How long does the unfreeze process take?
There are no fixed times. A bank hold depends on the bank's review. A Section 44A application depends on the agency. Judicial review under Order 53 goes through the High Court and takes longer. If no one is charged, an AMLA Section 44 freeze ends after 90 days, and a later seizure order lapses after 18 months under Section 52A.
What happens to my money after the freeze is lifted?
Your money stays in the account while it is frozen. Once the freeze is lifted, you can use your full balance again. The only exception is when a court has ordered specific funds to be forfeited, meaning taken by the state, in a criminal case.
Can the authorities refreeze my account after it is unfrozen?
Once an order lapses or is revoked, that order is over. Any other order would need its own legal basis, and your lawyer can check which orders are still in force and what they rest on.
