What should you look for in a frozen account lawyer?
Not every lawyer handles frozen bank accounts. In Malaysia the rules sit in several laws: AMLA, the Criminal Procedure Code and the 2024 changes to the Penal Code. A lawyer who handles these cases knows the steps under each one.
Look for direct experience with AMLA, asset freezes and financial crime investigations. [f5] Ask how many freeze cases they have handled and how those cases ended. A lawyer who has filed Section 44A variation applications or challenged freeze orders by judicial review knows things a general lawyer may not.
The Malaysian Bar Council directory lets you search for lawyers by practice area and state. [f3] It is a reliable place to start, but you still need to ask each lawyer about their experience with cases like yours.
Who needs a lawyer?
Anyone whose bank account is frozen gains from having a lawyer. That holds whether the freeze came from the police, an enforcement agency or the Public Prosecutor.
If you are arrested, Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice. [f1] You can also hire a lawyer at any stage, from the day you learn of the freeze through any investigation, court case or appeal.
A lawyer matters most if you are an innocent account holder whose account was flagged through no fault of your own. Clearing your name and regaining use of your funds involves legal steps that are hard to handle alone.
How does a lawyer help in AMLA and mule account cases?
A lawyer who handles AMLA and mule account defence cases gives three kinds of help.
Getting the steps right. The lawyer finds out which authority froze your account, files the right application with the right body, and meets every deadline. A written Section 44A application to the agency to release money for essential expenses needs exact documents. Filing with the wrong authority or missing a deadline can set your case back.
Building your case. The lawyer gathers and organises your financial records, prepares your statement, and works out which legal grounds apply to you. They can also look for past court decisions that may support you.
Protecting your rights. If police or investigators want to question you, your lawyer can advise you beforehand. If you are asked for documents, your lawyer checks what you must hand over and what you need not. This stops you from weakening your own case by accident.
What happens at the first consultation?
At the first meeting, the lawyer looks at your case and tells you what they can do.
You explain what happened, when you found out about the freeze and what you know about the reason. The lawyer reads your documents and asks questions to fill the gaps. By the end, you should know where you stand legally, what your options are and roughly how long things may take.
Some lawyers charge less for the first meeting, or count it towards the fee if you go ahead. Ask when you book.
How long does each step take?
There are no fixed times. It depends on which authority froze your account and how complex the investigation is.
Variation application (to release money for living expenses): your lawyer can prepare and file it early. How long a decision takes depends on the agency.
Challenging the freeze order (judicial review, or a written case to the authority): your lawyer needs time to prepare it, and the hearing and decision depend on the court or authority.
Full resolution (freeze lifted, account back in use): an AMLA Section 44 freeze lasts up to 90 days unless you are charged, and a later seizure order lapses after 18 months if no charge is filed. Cases that go to court follow the investigation and court process timeline.
What do lawyers charge in Malaysia?
Legal fees in Malaysia are governed by the Legal Profession Act 1976. [f4] You can ask for the fees in advance, and a good lawyer gives you a written estimate before you commit.
First consultation fees differ by lawyer and by how complex the case is. Ask the lawyer to confirm the fee before the meeting starts.
Case fees depend on how much work your case needs. A simple variation application costs less than a full judicial review. Ask for the fee broken down by task, so you know what each step costs.
Paying in stages may be possible. Some lawyers take payments at set points in the case rather than the full amount upfront. Ask about this at your consultation.
What changes when you have a lawyer?
AMLA and mule account cases have steps that are easy to get wrong alone.
With a lawyer, variation applications are more likely to be filed correctly, deadlines are met, and your case is put as strongly as the facts allow. Your lawyer deals with the authority for you, so you do not say or sign anything that makes things worse.
Without a lawyer, some account holders do not know which authority froze their account. They miss the chance to apply for a variation, or say things during police questioning that hurt their position. The AMLA steps and terms are hard to follow alone.
Do you need a general lawyer or a specialist?
A general criminal lawyer can represent you in court. A lawyer who focuses on AMLA, financial crime and frozen accounts can do that and more.
The difference is in the detail. A specialist knows what a variation application should contain and how the authorities involved work. They also know the evidence preparation process and can tell you exactly which documents to gather.
If your case is simple, such as a compliance hold placed by your bank, a general lawyer may be enough. If the police or the Public Prosecutor froze your account under AMLA, a specialist is worth asking for.
When is legal aid the right option?
If you qualify, legal aid is available in Malaysia from two main bodies.
Jabatan Bantuan Guaman (Legal Aid Department) gives legal aid based on a means test. [f2] If your household income is below its limit, you may get help at no or low cost. For criminal cases the main legal aid route is YBGK, so ask whether it can help with your case.
Yayasan Bantuan Guaman Kebangsaan (YBGK) covers criminal cases at arrest, remand and bail for Malaysians, and at trial and appeal subject to a means test. [f6] It does not cover offences punishable by death. Ask whether it can act in your case.
If your account is frozen and you cannot afford a private lawyer, apply to one of these bodies as early as you can. Applications take time, and early help protects your rights.
How do you prepare for your first consultation?
Preparing well makes the meeting more useful and helps the lawyer assess your case faster.
Gather your documents. Bring 12 months of bank statements, any letters from your bank about the freeze, letters from the police or other authorities, and any reference numbers. If you run a business, bring records that explain the business payments in your account.
Write a timeline. Note the date you found out about the freeze, what the bank told you, whether police or investigators have contacted you, and anything you have already done. Give exact dates and amounts.
Write down your questions. For example: how much it will cost, how long it may take, what the lawyer needs from you, and what the likely outcomes are. A good lawyer answers all of these clearly.
What happens after you hire a lawyer?
Your lawyer contacts your bank and the authority involved to confirm the details of the freeze. They review your documents and decide on the best approach. If a variation application to release money for living expenses fits your case, it may be filed first.
Your lawyer handles all contact with the authorities for you, so you should not have to face the police or investigators alone. If your case needs a court hearing, your lawyer prepares the application, represents you at the hearing and advises you at each step.
Throughout, your lawyer should keep you updated and explain what is happening and why.
Why get a lawyer early?
The Penal Code offences in Sections 424A, 424B and 424C and the police freeze power in CPC Section 116D were added in 2024. They are new, so ask any lawyer whether they have handled them.
The Malaysian Bar Council, Jabatan Bantuan Guaman and YBGK give you options at different income levels. [f3] [f2] [f6] The key is to get a lawyer early, before deadlines pass and before you deal with the authorities without advice.

How much does a lawyer cost for a frozen account case in Malaysia?
Consultation fees differ from lawyer to lawyer; a published guide puts criminal work billed by the hour at about RM200 to RM500 an hour [f7], so confirm any fee before you start. Fees for handling a frozen account or AMLA case depend on how complex it is, and some lawyers quote a fixed figure after seeing your documents. Legal aid is available if you qualify.
Can I use legal aid for a frozen account case?
Possibly. Jabatan Bantuan Guaman gives legal aid to people who pass its means test. Yayasan Bantuan Guaman Kebangsaan (YBGK) covers criminal cases at arrest, remand and bail for Malaysians, and at trial and appeal subject to a means test. For criminal cases YBGK is the main legal aid route. Ask each one whether it can help with your case.
What is the difference between a general lawyer and one who handles frozen accounts?
A general lawyer handles many kinds of cases but may not know the steps under AMLA, the Criminal Procedure Code changes or the new Sections 424A to 424C. A lawyer who handles these cases knows how to apply to vary a freeze, how to challenge the grounds for it, and how financial crime cases are run.
How quickly can a lawyer help unfreeze my account?
A written application to the enforcement agency under AMLA Section 44A, to release money for living expenses, is one of the first things a lawyer can prepare. How long the whole case takes depends on which authority froze the account and how complex the investigation is.
Do I need a lawyer if the police just want to ask questions?
If you are arrested, the Constitution (Article 5(3)) and CPC Section 28A give you the right to consult a lawyer before police questioning. A lawyer's advice helps stop you saying something that could be misread or used against you later. This matters most in AMLA and mule account investigations, where the penalties are heavy.
What should I bring to my first consultation with a lawyer?
Bring 12 months of bank statements, any letters from your bank, the reference number of the freeze if you have it, and a written timeline of what happened. The more you bring, the faster the lawyer can assess your case.
