Need a Lawyer for Your Police Statement?
Legal advice before your police statement helps you avoid words you cannot take back.

Why does this decision matter?
When police call you for a statement, your first instinct is to cooperate. That instinct is right, and cooperating does not stop you preparing.
A statement recorded under CPC Section 112 becomes a permanent part of the investigation file. [f3] Once you sign it, those words stay in the case file.
In frozen account and mule account cases, one answer can change your role. You may walk in as a witness and find your words used to build a case against you. The aim is not to refuse to cooperate, but to cooperate with the right support.
What is your right to a lawyer?
Article 5(3) of the Federal Constitution protects an arrested person’s right to consult and be defended by a lawyer of their choice. [f1] If you are called as a witness and not arrested, you can still take legal advice before you go. Whether your lawyer can sit in on the interview is up to the officer.
Under CPC Section 112, police can call and question anyone who may know the facts of a case. [f2] That power is real, and so is your right to get legal advice before you answer.
When should you have a lawyer?
Not every statement carries the same risk. Get a lawyer if your account has been frozen and the statement is about that money. Get one if police mention AMLA, money laundering or mule accounts.
Also get a lawyer if you received money from someone you barely know, or lent your account or ATM card to someone.
If you are simply a witness in someone else’s case, with no link to your own money, the risk is lower. Even then, a lawyer can make sure your answers are not used against you later.
What does a lawyer do at the statement?
Your lawyer does not answer for you. If the officer allows them in, they sit beside you and advise you on each question as it comes. If a question risks incriminating you, they guide you on how to answer or whether to decline.
After your answers are recorded, you are given the written statement to sign. If your lawyer is present, they check every line first. If it does not match what you said, your lawyer asks for the correction on the spot.
That check matters because an accurate statement counts if the case goes further. See our guide to the investigation process for more.
What can go wrong without a lawyer?
On your own, you answer every question on your own judgment. You may not spot a question aimed at proving what you knew or intended. You may say more than needed and give details the police did not ask for.
You may also sign a written version that does not quite match what you meant. None of this is deliberate. It happens because giving a statement is stressful, and the legal weight of each answer is not obvious to someone who is not a lawyer.
How much does help cost, and where can you get it?
Cost can put people off getting a lawyer. The Legal Aid Act 1971 provides legal representation for people with limited means. [f4] The Malaysian Bar also runs legal aid centres in Peninsular Malaysia.
Some private lawyers who handle frozen account and financial crime cases charge a fixed fee for a statement. Ask what it covers, such as preparing you beforehand, attending and checking the recorded statement.
The Legal Profession Act 1976 governs who may practise as a lawyer in Peninsular Malaysia. [f5] Check that your lawyer has a current practising certificate. Our guide to finding legal help explains what to look for.
How to prepare before the statement
Preparing helps whether or not you bring a lawyer. Gather your documents: bank statements, WhatsApp conversations and any record of money going in or out of your account. Our first hour actions guide covers what to do straight away.
Write a short timeline of events in your own words. It is not a legal document, just a memory aid that helps you answer accurately.
If you have a lawyer, share these documents before the appointment. A lawyer who knows the facts can advise you far better than one who walks in cold.
So, should you get a lawyer?
The law does not require a lawyer at a police statement. But in frozen account and mule account cases, legal advice can make a real difference to how you give your statement. If you are unsure, get legal advice before you go in.

Is it legally required to have a lawyer for a police statement?
No. Article 5(3) of the Federal Constitution protects an arrested person's right to consult a lawyer of their choice, and anyone can take legal advice before a statement. In a financial crime investigation, one badly worded answer can turn you from a witness into a suspect, so getting advice first is strongly recommended.
Can I give a police statement first and hire a lawyer later?
You can, but once your statement is recorded under CPC Section 112 and you sign it, it is part of the investigation file. If you said something wrong or harmful to yourself, a lawyer hired later has to work around it. Advice before the statement is far more useful.
How much does a lawyer cost for a police statement?
It depends on the lawyer and the case. Some lawyers charge a fixed fee for attending a statement session, so ask upfront. If you cannot afford one, the Legal Aid Act 1971 provides legal help for people of limited means.
What does a lawyer actually do during a police statement?
If the officer lets your lawyer attend, the lawyer advises you on each question, helps make sure your answers are recorded accurately, and flags questions that could incriminate you. They check the written statement before you sign and make sure police follow the CPC.
Can the police refuse to let me bring a lawyer?
The investigating officer controls the interview room, and practice varies. Ask politely and, if needed, arrange another date. A lawyer can contact the officer beforehand to ask to attend; if that is refused, you can still be advised before and after the session.
What if I cannot afford a lawyer at all?
The Legal Aid Department, under the Legal Aid Act 1971, helps people who qualify. The Malaysian Bar also runs legal aid centres. Apply before your statement date so help can be arranged in time.
Should I bring a lawyer even if I am just a witness?
It is wise. In financial crime cases, a witness can quickly become a suspect, and a routine-sounding question can lead to an answer that puts you under suspicion. A lawyer helps you cooperate fully while protecting your position.
