What does this service cover?
When someone is arrested and remanded in a mule account case, the first worry is how to get them out. This service is the practical work of getting a bail application before the court as early as the case allows.
The lawyer reviews the remand order and the charge, prepares the bail papers, and checks with the investigating officer when the case will next be in court.
Why do bailable offences still need preparation?
Penal Code Sections 424A, 424B and 424C, the sections most used in mule account cases, are all bailable offences [f2]. CPC Section 387 gives a right to bail once an offence is bailable [f1].
But that right still needs a properly filed application, a surety the court accepts, and someone keeping track of the remand period.
A missed step at this point can delay the application.
What happens during the remand period?
A remand order is for up to 4 days, with up to 3 more if the Magistrate agrees, and the police keep investigating during that time. The lawyer uses these days to gather the bail documents, confirm the surety is available, and find out exactly when the case is next in court.
Your lawyer can keep the family updated at each point, instead of leaving you waiting for a single piece of news.
What documents and surety are needed?
A bail application needs specific papers: ID for the accused and the surety, proof of address, and sometimes proof of work or income. The court or the police set the bail amount and conditions, based on how serious the charge is and the risk of the accused running away [f5].
The surety needs to be able to meet what the court is likely to ask for.
Much of this service is getting these papers ready before the hearing, so nobody is scrambling on the day.
What does the lawyer do at the hearing?
At the hearing, the lawyer makes the bail application, answers any objections from the prosecution, and confirms the conditions the court sets, such as reporting to a police station or travel limits.
Article 5(3) of the Federal Constitution guarantees the right to be defended by a lawyer of your choice at this stage [f3]. If you can avoid it, do not face this hearing without one.
Are bail and the frozen account separate?
Yes. Bail settles release from custody, not the bank account. A freeze under AMLA, or a police freeze under CPC Section 116D [f4], follows its own process, and a bail order does not lift it. Our page on the mule account defence service explains how both sides of a case can be handled together.
What can this service not promise?
No lawyer can promise what the bail amount will be or how soon the hearing will be set. For these bailable offences bail is a right, but the court or the police set the amount and conditions case by case. What you get is a properly prepared application, filed as early as the process allows, so nothing is held up by papers that could have been ready.
How do you get started?
If a family member has just been remanded, the quickest first step is to share the charge (if one has been filed), the officer’s name and the next court date. With these, a lawyer can explain what the bail process will look like in this case and start preparing the application.
Cost should not stop a family from getting advice. The Legal Aid Department may give legal help at low or no cost to Malaysians who meet its income criteria [f6]. Send the details on WhatsApp and ask to be referred to a lawyer.

What does a bail application service actually include?
The lawyer reviews the charge and the remand order, prepares the bail papers, checks timing with the investigating officer, gets the surety's documents ready, and makes the application in court. You are kept informed at each stage, instead of left to guess.
How fast can a bail application be filed?
It depends on when the remand order ends and when the case is next in court. Sections 424A, 424B and 424C are bailable offences [f2], so once a charge is filed, a lawyer can apply for bail at that same hearing instead of waiting for another date.
Who can act as a surety?
A surety (the person who guarantees the accused will turn up in court) can be a family member or someone else the court accepts as reliable. They sign an undertaking and may need to show ID and proof of address or income. The lawyer explains exactly what the court expects beforehand, so the surety knows what to bring.
Will getting bail also unfreeze the bank account?
No. Bail deals with release from custody, while a frozen account is a separate order under AMLA or CPC Section 116D [f4]. A bail order does not lift it.
What if the family cannot afford a lawyer right now?
The Legal Aid Department may give legal help at low or no cost to Malaysians who meet its income criteria [f6]. Talking to a lawyer early still matters: even a short consultation can make clear what the remand order allows and what happens next.
Can the lawyer visit the person in remand before the bail hearing?
Article 5(3) of the Federal Constitution guarantees the right to consult a lawyer of one's choice [f3]. Visits depend on the remand facility and the stage of the case, and the lawyer arranges this as part of preparing the bail application.
