Lawyer or Self-Representation in Freeze Cases
See what a lawyer who knows AMLA procedure adds, compared with handling your case alone.

Do you have a right to a lawyer?
Yes. Article 5(3) of the Federal Constitution says an arrested person may consult and be defended by a lawyer of their choice [f1]. Anyone can also hire a lawyer at any stage, from the moment the account is frozen, through the investigation and any court case.
You also have the right to represent yourself. No law makes you hire a lawyer for a frozen account or mule account case. The real question is whether going alone protects your interests.
What does a lawyer handle that you would find hard?
Frozen account cases under AMLA and the Criminal Procedure Code involve set procedures that need legal training [f2]. They are not general knowledge.
A variation application under AMLA section 44A lets you use frozen money for living costs. It is a written application to the enforcement agency that froze the account. It should be clear, go to the right officer and come with supporting documents arranged in a particular way. A weak application can be refused.
If the police froze your account under CPC section 116D, the person named can apply to the Sessions Court to vary or revoke the order [f3]. A lawyer can prepare that application. You cannot do this through the bank’s customer service or by turning up at a police station alone.
What difference does a lawyer make?
The difference shows in three areas: speed, accuracy and protection.
Speed. A lawyer knows where and how to file, so applications are less likely to go to the wrong place or in the wrong format.
Accuracy. Everything you tell the police, every document you hand in and every court filing goes into your case record. A lawyer makes sure what you say and submit supports your position. Without advice, you can make your case harder without realising it.
Protection. During police questioning, a lawyer advises you which questions to answer and which you may decline [f1]. Without one, you may give answers that weaken your position. This is especially true in mule account investigations, where the line between cooperating and incriminating yourself is not obvious.
How much does a lawyer cost?
Fees are a real worry. The Legal Profession Act 1976 governs lawyers’ qualifications, conduct and fees [f4].
Fees vary by firm. One published guide puts criminal work billed by the hour at about RM200 to RM500 an hour [f6]. Ask the lawyer to confirm any fee in writing before you start.
Weigh this against what a long freeze costs you. If your salary account is frozen, every week without access is a week without income. If your business account is frozen, the business stops.
Legal aid is there for people who qualify. YBGK, the National Legal Aid Foundation, covers criminal cases at arrest, remand and bail for Malaysians, and at trial and appeal subject to a means test.
When might you manage without a lawyer?
Not every frozen account needs a lawyer. Your bank may have put a temporary compliance hold on the account, which is not a police or AMLA freeze. If it says the hold will lift once you provide identity documents, you may be able to sort it out with the bank directly.
If the freeze was ordered by an enforcement agency such as the police, or by the Public Prosecutor, going alone carries real risk [f5]. The procedures are built for lawyers, the deadlines are strict and mistakes are costly.
What should you do right now?
If your account is frozen and you are deciding whether to get a lawyer, take these steps today.
Find out who froze your account. Call your bank and ask whether the freeze came from the police, another enforcement agency, the Public Prosecutor or the bank itself. This decides which legal route applies.
Gather your documents. Collect your bank statements for the past 12 months, any notices from the bank and any letters from the police or other authorities. Write down what happened, with dates.
Get a legal view. Even if you are unsure about hiring a lawyer, one consultation will tell you what you face and what your options are. Confirm any fee with the lawyer before you start.
The guides on first steps after a freeze and finding the right lawyer explain each step in detail.
What is the real risk of going alone?
The main risk is not that you will lose. It is that you make the process slower and harder for yourself without realising it.
A statement given to the police without advice cannot be taken back. A filing sent to the wrong place wastes weeks. A missed deadline on a variation application means longer without your money.
Get a clear assessment from someone who handles these cases regularly, whether or not you then hire them.

Can I represent myself in a frozen account case in Malaysia?
Yes, you have the right to. But AMLA and CPC procedures have set filing formats, court rules and deadlines that can be hard to manage without legal training. A missed deadline or a wrong filing can delay your case.
How much does a lawyer cost for a frozen account case?
Fees vary by firm. One published guide puts criminal work billed by the hour at about RM200 to RM500 an hour [f6], so confirm any fee with the lawyer before you start. A retainer depends on how complex the case is. If you qualify, legal aid through YBGK may be available, depending on your means.
What can a lawyer do that I cannot?
A lawyer can prepare a written variation application to the agency under AMLA section 44A in the right format, deal with investigators for you and protect your rights during police questioning.
Is it too late to get a lawyer if I already gave a statement?
No. A lawyer can still review what you said, advise on next steps and act for you from here on. Earlier is better, but a lawyer can help at any stage.
What if I cannot afford a lawyer?
You can ask about legal aid through YBGK, the National Legal Aid Foundation. It covers criminal cases at arrest, remand and bail for Malaysians, and at trial and appeal subject to a means test. Apply early.
Can a lawyer guarantee my account will be unfrozen?
No. No lawyer can guarantee an outcome. What a lawyer does is present your case as strongly as the facts allow, file the right applications, meet every deadline and protect your rights throughout.
