What is a frozen bank account?

A frozen bank account is one where an authority has stopped all transactions. You cannot withdraw, transfer or receive money. Your balance stays in the account, but you cannot touch it until the freeze is lifted or changed.

In Malaysia, several authorities can order a bank to freeze your account. The reason, the law behind it and the way to unfreeze it all depend on which authority made the order.

Who can freeze your account in Malaysia?

Several authorities can freeze bank accounts in Malaysia. Each works under a different law and follows a different process.

The police (PDRM) can freeze accounts straight away under Section 116D of the Criminal Procedure Code, as amended in 2024. [f6] Officers of sergeant rank and above can block transactions without a court order if they suspect the account is linked to illegal activity.

This route is used in mule account investigations. If the police have contacted you about your account, read the first steps to take.

The Public Prosecutor can order a freeze under Section 50(1) of AMLA. [f1] This covers accounts suspected of holding money from crime, money laundering or terrorism financing.

An AMLA enforcement agency (for example the police, Bank Negara or MACC acting under AMLA) can freeze property under Section 44 while it investigates. [f7] If you are not charged, that order ends after 90 days.

The courts can order a freeze through garnishee proceedings (to recover a civil debt) or as part of a criminal case. A court freeze needs a formal application and a hearing.

Why might your account have been frozen?

A freeze can have several causes.

Suspicion of a mule account. If money linked to a scam or fraud passed through your account, even one payment, the account can be flagged and frozen.

An AMLA investigation covers money laundering, terrorism financing and the proceeds of crime. The freeze holds the money while investigators trace where it came from.

A restriction by your own bank happens when its compliance system spots something unusual. Sudden large transfers, many quick payments, or activity that does not fit your usual pattern can trigger a review.

What are your rights while your account is frozen?

A freeze is part of an investigation. It is not a finding that you are guilty, and you keep specific rights under Malaysian law.

You can ask your bank which authority ordered the freeze, though it may not be able to tell you everything.

You can get legal advice at any stage. If an enforcement agency froze the account under AMLA Section 44, you can also apply in writing to the enforcement agency under AMLA Section 44A to change the freeze order so you can pay essential living costs.

A lawyer can also advise whether a court challenge, such as judicial review, is possible in your case.

How long can a freeze last?

Under AMLA Section 52A, a freeze or seizure order lapses if the person is not charged within 18 months. [f2] An AMLA amendment in force since 1 March 2026 raised this limit from 12 months. If no prosecution starts within the 18 months, the order ends automatically.

There is one exception. If the Public Prosecutor applies to the High Court for forfeiture before the deadline, the money can stay held until the court decides. So an approaching deadline does not always mean the money is released.

Police freezes under CPC Section 116D also end after 18 months if no prosecution starts. [f6] Until then they stay in place while the investigation continues. You can apply to the Sessions Court to vary or revoke one.

How long a freeze takes to resolve depends on its facts, including how quickly the account holder cooperates and hands over documents. We do not have a reliable typical time frame to quote.

What are the mule account laws: Sections 424A, 424B and 424C?

In 2024, Malaysia added specific offences for mule accounts to the Penal Code.

Section 424A covers having or controlling someone else’s payment card or bank account without lawful authority. The penalty is a fine of RM5,000 to RM50,000, six months to five years in prison, or both. [f3]

Section 424B targets account holders who hand control of their own account to someone else. The penalty is a fine of RM10,000 to RM100,000, one to seven years in prison, or both. [f4]

Section 424C covers engaging in transactions through an account without a lawful purpose. It carries the heaviest penalty: 3 to 10 years in prison, or a fine of RM10,000 to RM150,000, or both. [f5]

What should you do when your account is frozen?

What you do in the first hours and days matters. The immediate action guide covers this in detail. The main steps are below.

Confirm the freeze with your bank. Ask which authority ordered it and ask for any reference numbers. Write down the date, the name of the person you spoke to and what they said.

Do not open a new account to move money. It can look like an attempt to get around the investigation and can create new legal problems.

Gather your documents. Collect 12 months of bank statements, any letters from the bank, and papers that show where the money in your account came from.

Contact a lawyer who handles AMLA and frozen account cases. The process has set steps and time limits. A qualified lawyer can find the right authority, prepare applications and represent you during any investigation.

Cooperate with the investigation. If police or investigators contact you, you can consult a lawyer before you speak to them. Cooperating means giving truthful information through the proper channels while your rights are protected.

What if the freeze has nothing to do with AMLA?

If your own bank froze the account over compliance concerns, not because of a police or AMLA order, the process is simpler. Contact the bank’s compliance department and give them the documents they ask for. Ask how long its review takes.

If the freeze is a garnishee order from a civil court over a debt, it goes through the civil courts, not criminal law. A lawyer who handles civil litigation is the right choice.

Freezes linked to bankruptcy or tax disputes with LHDN need their own specialist advice.

What helps your case?

Keeping your financial records in order is the most useful thing you can do before and during a freeze investigation. Bank statements, tax returns, employment records and proof of where your money came from can all show that your money is lawful.

If you run a business, keep clear records that separate personal and business payments. Mixed funds in a personal account are harder to explain to investigators.

If you often receive large transfers from overseas, keep papers showing where each came from and why. Remittances, business payments and investment returns all have documents an investigator can check.

What happens after the freeze is lifted?

Once the freeze is lifted, your account works normally again. The money in it stays yours unless a court has ordered it forfeited.

If you were charged and acquitted, ask your lawyer how to get the money released.

If the order ended after 18 months with no prosecution, and no forfeiture application was made before the deadline, your access returns automatically. The investigation may continue.

Why do innocent account holders get caught up?

Scam victims can call the National Scam Response Centre (NSRC) on 997, which runs 24 hours. Funds can be traced and frozen very quickly after a report, sometimes within hours. This protects victims, but innocent account holders can also get caught up.

The law has ways to protect innocent account holders, but you have to use them. A short WhatsApp message explaining your situation is enough to be referred to a lawyer who can tell you which of them apply to you.

Can I still receive my salary if my account is frozen?

A frozen account usually blocks all money going in and out. If an enforcement agency froze it under AMLA Section 44, you can apply in writing under Section 44A to change the order so that essential living costs can be paid. Ask the agency how your salary can be paid in the meantime. A lawyer can prepare the application for you.

Who froze my account and how do I find out?

Ask your bank; it can tell you who ordered the freeze. It may be the police under CPC Section 116D, an enforcement agency under AMLA Section 44, the Public Prosecutor under AMLA Section 50, or a court. Which one it was decides how you challenge it.

Can police freeze my account without going to court?

What is the difference between a frozen account and a mule account?

A frozen account is any account an authority has blocked. A mule account is one used to receive, hold or move money from crime. Your account can be frozen even if nobody accuses you of running a mule account.

The law does not require one, but the steps under AMLA and the Criminal Procedure Code are specific. A lawyer who handles these cases can find out which authority froze your account, prepare a variation application and protect your rights.
