Why Property Sale Deposits Trigger Freezes

You sold your house, flat or land the proper way. A conveyancing lawyer did the paperwork, the buyer signed the SPA, stamp duty was paid and the money went into your bank account. Then the account was frozen.

Banks must report large single deposits that do not fit your usual activity. [f1] RM200,000, RM500,000 or more arriving in an account that normally gets a few thousand ringgit of salary a month stands out in the bank’s checks.

The bank may have filed a Suspicious Transaction Report, and the authorities may have frozen the account under AMLA section 44. [f2] That does not mean you are accused of a crime. It means the deposit was flagged and the authorities want to check where it came from.

Your SPA Is Your Most Useful Evidence

A property sale in Malaysia leaves a long paper trail. [f5] The Sale and Purchase Agreement (SPA) is at the centre of it. It records the property address, the buyer and seller, the price, the payment schedule and the completion date.

The SPA is stamped at the stamp office, so the government holds its own record of the sale. That record is strong proof that the money in your account matches a real, documented sale.

Also collect the stamp duty receipt, Form 14A (the transfer document), your conveyancing lawyer’s completion letter, and any letters with the buyer or the buyer’s lawyer. Each one adds to the proof.

What to Do Right Now

Ask your bank which authority ordered the freeze and get the investigation reference number. Ask whether you can send supporting documents straight to the bank’s compliance team.

Ask your conveyancing lawyer for copies of every paper from the sale. Their file should hold the SPA, title search, completion account and payment records. These papers were made during the sale itself, so they are independent proof.

Get the bank statements that show the deposit and any related payments. If the buyer paid in stages, the statements will show deposits that match the SPA payment schedule.

Putting Your Evidence Together

A lawyer who handles frozen account cases will put your sale papers into one evidence bundle for the investigating officer. The bundle matches each deposit to the payment listed in the SPA.

For example, if the SPA shows a deposit on one date and the balance on completion, your statements should show money arriving on or near those dates. Matching the SPA to the bank records line by line is the clearest proof that the sale was genuine.

Add your RPGT (Real Property Gains Tax) filing if one applies. Paying tax on the sale can show again that it went through the proper channels.

Asking for Some Money to Be Released

If you need money for daily costs while the freeze lasts, AMLA section 44A lets you make a written application to the enforcement agency that froze the account. [f3] You set out your monthly costs, your dependants and what you owe.

A more senior officer decides, and can release part of the money for rent, food, bills, loan payments and other basics. A lawyer can prepare this application alongside your sale evidence, so both the money pressure and the investigation are dealt with.

How long can the freeze last?

An AMLA section 44 freeze lapses after 90 days unless you are charged. Under AMLA section 52A, a seizure or section 50 order lapses if no one is charged within 18 months. [f4]

A lawyer can put your SPA and other papers in front of the investigating officer early, so the officer can check the sale.

Why Your Papers Count in Your Favour

Few transactions in Malaysia are as well documented as a property sale. The SPA, stamp duty, Form 14A, RPGT filing and conveyancing records form an official trail anyone can check. That is exactly what investigators need to confirm the deposit is genuine.

When a lawyer sets these records out clearly, the investigating officer can check them against the deposit.

Why was my account frozen after receiving property sale proceeds?

Banks watch for large deposits that do not fit your usual pattern. Hundreds of thousands of ringgit landing in a personal account can set off automatic checks. The bank may file a report, and the authorities may freeze the account while they check where the money came from.

I have my SPA. Is that enough to unfreeze my account?

The SPA is the key document, but also collect the stamp duty receipt, your lawyer's completion letter, the buyer's payment records and your bank statements. Together they show a complete, genuine property sale.

How long will my property sale money stay frozen?

It depends on the order. An AMLA section 44 freeze lapses after 90 days unless you are charged, and a section 50 order lapses under section 52A if no one is charged within 18 months [f4]. A property sale leaves a long paper trail that can be checked against government records.

Can I access some of the money for living expenses?

You can ask. Under AMLA section 44A you make a written application to the enforcement agency that froze the account, setting out your monthly costs and commitments. A more senior officer decides, and can release part of the money for rent, food, bills and other basics.

Does this mean I am being investigated for money laundering?

The freeze is a step in an investigation, not an accusation. The bank flagged a large deposit that did not fit your usual activity. If you show the money came from a genuine property sale, that can help the authorities close the matter.

What if the buyer paid in cash or multiple instalments?

Cash or many instalments can raise more questions. Collect a receipt for every payment, together with the SPA showing the full price. A lawyer can line these up to show the payments add up to the agreed price.
