Why can a loan repayment freeze your account?

You lent money to a business contact, friend or relative. They paid it back with one large transfer to your account. Then the account was frozen.

Banks can flag large transfers between individuals that have no clear business papers behind them. [f1] A large transfer from one person to another can set off the bank’s checks. Without papers, the bank cannot tell a loan repayment from a suspicious transfer.

In a case like this, the bank may have filed a Suspicious Transaction Report, and an enforcement agency may have frozen the account under AMLA Section 44. [f2] This does not mean you are accused of a crime. It means the transfer is being checked.

Which loan documents help most?

A written loan agreement or promissory note can serve as evidence of a genuine loan. [f5] A signed agreement showing the amount, the repayment terms and both names can be strong proof that the transfer was a repayment.

The strongest proof shows the whole cycle: money leaving your account as a loan, then coming back as repayment. Your bank statements showing the original transfer, together with the agreement, make that cycle clear.

A promissory note, post-dated cheques or a written repayment schedule can help. Each one shows the repayment was planned, not an unexplained deposit.

What should you do right now?

Ask your bank which authority ordered the freeze and for the investigation reference number. Ask which transactions set it off.

Find the loan agreement and every related document. If the borrower is a company, also gather its SSM records, the board resolution approving the loan and any company letters about it.

Get your bank statements for the month you lent the money. Mark the transfer out that matches the agreement. Then match it to the repayment that came in.

Do not ask the borrower to explain things to the bank. The borrower may also be under investigation, and direct contact can make things harder. Let your lawyer handle it.

What goes into your evidence file?

A lawyer who handles frozen account cases can put your loan papers into one file for the investigating officer. The file should show three things.

First, the loan: the agreement, the transfer out of your account and what the loan was for. Second, the repayment: the agreed schedule and the transfer in that matches it. Third, the relationship: who the borrower is and why you lent them money.

For a business loan, add the borrower’s business registration and what the money was for, such as equipment, stock or working capital. Add any records showing how it was used.

For an informal loan, gather texts, emails or WhatsApp chats about it. Screenshots where the borrower admits the debt or talks about repaying are useful.

What if the borrower’s money came from a bad source?

If the borrower repaid you with money from a suspicious source, the investigation may look beyond your loan papers.

Your agreement explains why you received the money. The investigating officer may still ask where the borrower got it. That is a separate question from whether your loan was genuine.

If that is what happened, a lawyer can put your position plainly: you made a documented loan, the borrower repaid it on the agreed terms, and you had no reason to suspect where the money came from.

Can you use some of the money in the meantime?

If you need money for daily costs, AMLA Section 44A lets you apply in writing to the enforcement agency to vary a Section 44 freeze. [f3] Set out your monthly costs, dependants and commitments.

It can allow part of the money to be used for rent, food, utilities and other essentials. A lawyer can prepare this application alongside your loan evidence.

How long can the freeze last?

A section 44 freeze lasts up to 90 days unless you are charged. Under AMLA Section 52A, a section 50 order lapses after 18 months if no one is charged. [f4] Handing in clear loan records early can help your case.

Why did a loan repayment trigger an account freeze?

Banks watch large transfers between individuals for signs of money laundering. A large transfer from another person, with no business reason shown, can look unexplained. The bank may report it, and an authority may then freeze the account while the source is checked.

I have a loan agreement. Is that enough to unfreeze my account?

It is an important document, but add to it. Include the bank statement showing the original loan going out, and any promissory note or written acknowledgment of the debt. Together they show the money leaving as a loan and coming back as repayment.

What if the loan was informal and I have no written agreement?

It is harder to prove, but still possible. Gather texts, WhatsApp chats or emails about the loan. Bank statements showing your original transfer to the borrower help show the loan was real. A lawyer can put what you have into one clear file.

Does it matter where the borrower got the repayment money?

Yes. If the borrower repaid you with money from a crime, the police may look into that source. Your loan papers explain why you received the money. Where the borrower got it is a separate question the investigation will look at.

How long will my account stay frozen?

A section 44 freeze lasts up to 90 days unless you are charged. A section 50 order lapses after 18 months if no one is charged (Section 52A). Clear records of the loan and the repayment terms can help your case.

Can I access some of the money while the investigation continues?

If an enforcement agency froze the account under Section 44, you can apply in writing to that agency under AMLA Section 44A, setting out your monthly costs and commitments. A more senior officer decides and can allow part of the money for rent, food, utilities and other essentials.
