Sole Proprietor Account Frozen? Keeping Your Business Running
Your personal account is your business account, and now both are frozen.

The Sole Proprietor Problem: One Account for Everything
Some sole proprietors run everything through one bank account. Personal savings, customer payments, supplier transfers and family spending all go through it. When that account is frozen, your personal life and your business stop together.
Unlike a Sdn Bhd company, a sole proprietorship is not a separate legal entity from its owner. [f1] So a freeze on your personal account is a freeze on your business. Nothing legally separates the business from your personal banking.
The freeze hits everything in one go, but there are legal steps you can take.
Why Your Account Was Frozen
The authorities freeze accounts under AMLA when they suspect the account received or moved money from unlawful activity. [f2] For a sole proprietor, this can happen in several ways.
A customer’s payment may have come from a scam victim’s account. A supplier may have used your account in a way that set off the bank’s checks. Or a pattern that looks normal to you may have looked suspicious to the bank’s compliance team.
A freeze does not mean you did anything wrong. It means the authorities are looking into a transaction linked to your account. Our guide to understanding account freezes explains the different types of freeze order.
What Stops When Your Account Is Frozen
The effect is immediate and wide. For a sole proprietorship, a frozen account means:
Customer payments. Bank transfers from customers cannot reach the frozen account. DuitNow and online transfers will fail or bounce back, so you cannot take electronic payments.
Supplier and rent payments. Bills cannot be paid from the frozen account. You risk losing suppliers and your premises, and a landlord who is not paid can act under your tenancy agreement.
Staff wages. If you have staff, you cannot pay them from the frozen account. Our payroll guide covers your duties and risks around wages.
Tax and statutory payments. Income tax instalments, SST (if it applies to you) and other payments to LHDN cannot be made from the frozen account. [f3]
Your SSM and LHDN Duties Continue
A frozen account does not pause your business’s legal duties. SSM requires you to keep your business registration up to date, including renewing on time. [f4] If you miss a renewal, your registration can lapse, which causes further problems.
LHDN requires sole proprietors to file Form B every year. [f3] CP500 tax instalments must still be paid. If the freeze stops you paying, write to LHDN to explain and keep a copy of the letter. A tax adviser or lawyer can help with this.
Keep all your business records safe during the freeze. Invoices, receipts, bank statements and accounts may be needed for the investigation and for your variation application.
Applying for a Variation
If an enforcement agency froze the account under AMLA Section 44, Section 44A lets you apply in writing to that agency to vary the freeze so that some money is released. [f5] For a sole proprietor, the application can cover essential business and personal costs.
Your lawyer prepares the written application with supporting documents. Bring your tenancy agreement, supplier contracts, staff records, utility bills and a list of regular business payments. The application must show these are genuine running costs.
A variation does not unfreeze your whole account. It lets the bank release set amounts for approved purposes. Conditions may be attached, such as receipts for each release.
An application that clearly shows genuine business needs is easier for the officer to assess. Our guide on finding legal help can put you in touch with a lawyer who handles AMLA matters.
Separating Business and Personal Money
The freeze shows the risk of running everything through one account. While you deal with it, think about setting things up to protect yourself in future.
Once your lawyer confirms it is safe, consider a business-only account in your own business name. Send future business income there and use it only for business costs.
Keep separate records of personal and business spending. That makes it easier to show your business is genuine if questions come up. It also simplifies your yearly tax filing and SSM paperwork.
If you sell through Shopee, Lazada or your own website, change your payout details to an account that is not frozen as soon as you can. Acting quickly limits the damage to your business.
What to Do in the First 48 Hours
Speed matters. In the first two days:
-
Confirm the freeze with your bank. Ask in writing which authority ordered it and what it covers.
-
List what you owe. Write down every payment due in the next 30 days: rent, suppliers, wages, tax instalments and SSM renewals.
-
Contact key suppliers and your landlord. Explain you have a temporary banking problem and offer temporary arrangements in writing.
-
Speak to a lawyer. A lawyer can start your variation application straight away. Our guide on what to do now has the full plan.
-
Protect your records. Do not delete any transaction records, bank statements or business documents. They support your side in the investigation and your variation application.

Can I open a separate business account while my personal account is frozen?
Ask your lawyer first. Do not open a new account to get around the freeze. Whether a new business account is sensible depends on what the freeze order covers, and a new account may be frozen too if the order covers all your accounts.
Do I still need to pay tax if my account is frozen?
Yes. Your LHDN tax duties continue whatever is happening with your bank, and Form B must be filed on time. If the freeze stops you paying tax instalments, tell LHDN in writing and keep copies. A lawyer can include tax payments in your variation application.
What happens to my SSM registration during the freeze?
You must keep it active. Renewal deadlines do not pause for a freeze, and a missed renewal can let your registration lapse, which causes more problems. Pay the renewal fee from money that is not frozen if you can.
Can I accept cash payments from customers during the freeze?
Yes, you can keep trading and taking cash. The frozen account will not accept deposits, so ask your lawyer where to put the cash. Keep detailed records of every cash sale.
Will my suppliers find out about the freeze?
Suppliers will notice missed payments. Contact your main suppliers early and explain you have a temporary banking problem. You do not need to share details of the investigation. Putting temporary arrangements in writing protects the relationship.
How long will my business be affected?
An AMLA freeze lapses if no one is charged within 18 months. A variation can release money for essential business costs while the investigation continues. Plan for a long period to protect your business.
