How can a customer payment freeze your business account?

You sold goods or a service and the customer paid you. That part is ordinary business. The problem is where the customer’s money came from. [f2]

If the customer paid with money taken in a scam, the victim reports it and the police trace the money. When the trail reaches your business account, the account can be frozen under AMLA 2001.

The freeze covers the whole account, not just that customer’s payment. Wages, suppliers, rent and every other payment are blocked while the police investigate.

Why do innocent businesses get caught?

You may have had no way to know where the customer’s money came from. A business taking payment for a sale does not normally check the source of each customer’s money.

Banks have anti-money laundering duties to check where money comes from. Taking a normal price for a real product or service is ordinary trade.

A freeze is a precaution, not an accusation. The police need to find out whether your business knew, or simply received the money in good faith. Your business records are what show the second.

What rights do you have as a business owner?

You have several rights when your business account is frozen.

You can find out who froze it. Ask your bank which authority made the freeze and for the reference number. Your lawyer needs this to act.

You can ask for money to be released. Under AMLA Section 44A, you can apply in writing to the agency that made the freeze to vary it, so money is released for essential business costs. [f1] Explain how the freeze affects your staff and suppliers.

You can give evidence. You can hand the police business records showing the payment was a genuine sale. [f4] Invoices, delivery notes, purchase orders and messages with the customer all help.

The freeze has a time limit. Under AMLA Section 52A, a section 50 order lapses if no one is charged within 18 months, and a section 44 freeze lasts up to 90 days unless you are charged. [f3]

What should you do right now?

Start on these steps as soon as you learn of the freeze.

Record the sale. Gather the invoice, quotation, purchase order, delivery proof, payment receipt and every message with the customer. A complete record of the sale is strong evidence. [f4]

List what you must pay soon. Write down upcoming wage dates, supplier bills, rent, utilities and loan repayments. This list is the basis of your variation application and shows the real effect of the freeze.

Tell the people affected. Let your staff, main suppliers and landlord know there is a problem with the account and that you are dealing with it. Being open can buy you time while the legal process runs.

Do not use workarounds. Do not move business money through personal accounts or anyone else’s account. That can raise more suspicion and make the case harder.

Speak to a lawyer early. A lawyer who handles business account freezes can make the variation application, deal with the investigating officer and work toward lifting the freeze. When wages are due, early action matters.

How can a lawyer help your business?

A lawyer can work on four things.

Releasing money for running costs. The first aim is cash flow. Your lawyer applies in writing to the agency under Section 44A for money to cover wages, rent, suppliers and other essential costs.

Building your evidence. Your lawyer puts your records into one file: SSM registration, tax returns, accounts, the records of the sale and your messages with the customer. The file shows your business is real and the payment was ordinary trade.

Dealing with the police. Your lawyer speaks to the investigating officer, hands over your evidence and follows up on progress.

Lifting the freeze. If your business received the money in good faith, your lawyer can ask the authority to lift the freeze.

Can my business account be frozen over one customer payment?

Yes. If money traced from a scam victim reached your account as payment, the police can freeze the whole account while they investigate. The freeze is about where the money came from, not how you run your business. Your records help show it was an ordinary sale.

Can I apply to release funds for payroll and operating costs?

Yes. Under AMLA Section 44A, you or your lawyer can apply in writing to the agency that made the freeze to vary it. The application can cover wages, suppliers, rent, utilities and other essential costs. Show exactly what each payment is for.

How do I prove the payment was a genuine sale?

Gather the invoice, delivery records, purchase order, messages about the sale and your tax records. Under the Evidence Act 1950, business records like these can be used as proof. A full paper trail showing a real sale at a normal price helps your case.

How long will my business account stay frozen?

A section 44 freeze lasts up to 90 days unless you are charged, and a section 50 order lapses after 18 months without a charge (Section 52A). It can end sooner if the authority is satisfied earlier. Giving complete records early can help.

Can I open a new business account at another bank?

A new bank may say no if it sees the freeze. Do not use a new account to move the frozen money. A lawyer can advise before you approach a bank.

Will my employees be affected?

If wages are paid from the frozen account, that route is blocked. You may need a temporary arrangement, such as paying from another account in the business's own name. A variation application can also ask for money to be released for wages.

Am I personally liable as the business owner?

If the business is a company (Sdn Bhd), it depends on your own part in the sale. If you did not know the customer's money came from a scam, that may count in your favour. A lawyer can assess your own position on the facts.
