What is a freeze letter?
A freeze letter is a formal notice from your bank saying access to your account has been blocked. It may come as a letter, an email, an SMS or a notice in your banking app.
Some people only find out when their card stops working or a transfer fails, and the letter comes a day or two later.
The letter is not a court summons or a criminal charge. It means an authority has told your bank to hold the money in your account while a matter is looked into. [f5] Your money is still there. You just cannot use it for now.
If you have just received this letter, take a breath. The next few steps matter.
Who ordered the freeze?
Your letter should name the authority that ordered the freeze. Knowing who issued it tells you which legal process applies.
Enforcement agency (AMLA Section 44). An agency such as the police can freeze property it suspects is linked to money laundering. This freeze ends after 90 days unless you are charged. The letter will mention AMLA.
Public Prosecutor (AMLA Section 50(1)). The Public Prosecutor can order a bank not to part with money suspected to be proceeds of unlawful activity. [f1] The letter will mention AMLA and give a reference number.
Police (CPC Section 116D). Since the 2024 amendment to the Criminal Procedure Code, police officers can freeze accounts linked to ongoing criminal investigations. [f2] If your letter cites CPC 116D, the police are investigating something connected to your account.
The bank itself. Banks restrict accounts under their own anti-money laundering duties and account terms. This can look like a compliance hold rather than a formal freeze order.
If your letter does not say clearly who ordered the freeze, note that too. A lawyer who handles frozen accounts can often tell the authority from the letter’s wording and reference numbers.
How to read your freeze letter
Every freeze letter contains a few key details. Here is what to look for.
The law cited. This is the section of law the freeze is based on, such as AMLA s44, AMLA s50(1), CPC s116D or the bank’s own terms. It tells you which legal route your case is on.
The reference number. This is the case or file number for your matter. Write it down and keep it safe. You will need it every time you deal with your bank, your lawyer or the authority.
The date of the order. Freeze orders have time limits. An AMLA Section 44 freeze lasts up to 90 days unless you are charged, and under Section 52A a later order lapses if no one is charged within 18 months of its date. [f3] Knowing when the clock started helps you and your lawyer plan.
What is frozen. Some letters say whether the freeze covers the whole account or only certain funds. Our guide on partial vs full freezes explains what this means for your daily money.
What the freeze means for your money
Your money stays in your account. The freeze stops you withdrawing, transferring or using it, but the money has not been seized or taken. The bank is holding the account on the instruction of the authority named in the letter.
If your salary account is frozen, your employer’s payments may still go in, but you cannot use them. Our guide on what to do now covers practical steps for managing money during a freeze.
You have the right to apply in writing to the enforcement agency to vary the freeze order under AMLA Section 44A. [f4] This is a written application to the agency that issued the freeze, asking it to release money for living costs such as rent, food, utilities, medical bills and school fees. A lawyer can prepare this application for you.
What to do in the first 24 hours
What you do right after receiving the letter shapes everything that follows.
Photograph every page of the letter, front and back. Keep the photos somewhere other than your phone, such as an email to yourself or a cloud drive.
Write down the key details: the law cited, the reference number, the date of the order, and the name and contact details of the bank officer on the letter.
Do not move money. If you have other accounts that still work, do not move money into or out of them because of the freeze. It can raise more suspicion. Read more about your rights as an account holder during this time.
Contact a lawyer. A lawyer who handles frozen account cases can read the letter, work out which authority is involved, explain the process and start on your response. Waiting does not help here.
Gather supporting documents. If you know which transactions may have caused the freeze, collect invoices, contracts, payslips or transfer records that explain them. Our evidence preparation guide explains what to collect and how to organise it.
Why was your account frozen?
A freeze letter does not mean you did anything wrong. Accounts are frozen for many reasons, and an innocent account holder can be caught up.
Your account may have received money from someone whose own account is under investigation. A pattern of transactions may have matched an automatic flag in the bank’s system. Someone may have reported a scam and named your account as the one that received the money.
Reading how account freezes work and the difference between a police freeze and a bank freeze helps you see where your case fits.
How long does the freeze last?
A freeze is not permanent. An AMLA Section 44 freeze lasts up to 90 days unless you are charged, and a later seizure or Section 50 order lapses after 18 months if no one is charged and no prosecution has started. [f3]
A police freeze under CPC Section 116D lapses after 18 months if no one is charged, and a Sessions Court can vary or revoke it earlier. Read about freeze duration and what affects it for more detail.
If you want the freeze lifted sooner, your lawyer can apply to the authority or the court involved. The freeze lifted process guide explains how this works step by step.
When to get legal help
A freeze letter is a legal matter. You can read it yourself, but answering the authority behind it and protecting your rights along the way is work a lawyer can do better.
Speak to a lawyer as soon as you get the letter. Do not wait to see if the freeze lifts by itself. Getting a lawyer involved early can help you avoid mistakes.
A qualified lawyer can identify the authority involved, explain the timeline, apply for money to be released for living costs, and prepare your response to the investigation behind the freeze.

What does a freeze letter from my bank mean?
It means an authority has ordered your bank to block access to your account. The letter names the law used and gives a reference number. Your money is still in the account, but you cannot withdraw, transfer or use it until the freeze is lifted or varied.
Who has the power to freeze my bank account?
Several authorities can. An enforcement agency such as the police can freeze under AMLA Section 44. The Public Prosecutor can order under AMLA Section 50(1). Police can also act under CPC Section 116D since 2024. Banks can also restrict an account under their own anti-money laundering duties.
How long can my account stay frozen?
Under AMLA Section 52A, a freeze ordered by the Public Prosecutor lapses if no one is charged within 18 months of the date of the order. A police freeze under CPC Section 116D also lapses after 18 months if no one is charged. A lawyer can apply for an earlier release or for money for living costs.
Can I get money released for living expenses?
Yes. AMLA Section 44A lets you or your lawyer apply in writing to the enforcement agency to vary the freezing order. The written application asks for part of the frozen money to be released for costs such as rent, food, utilities and medical bills. You will need proof of these costs.
What should I do as soon as I receive the freeze letter?
Read it carefully and note the law cited, the reference number, the date and the authority that issued it. Do not ignore it. Photograph every page, gather recent bank statements and any papers about the transactions in question, and contact a lawyer who handles frozen account cases.
Is my account frozen by the bank or by an authority?
The letter will tell you. If it cites AMLA Section 44, an enforcement agency such as the police ordered it. If it cites Section 50(1), the Public Prosecutor did. If it cites CPC Section 116D, the police did. If the bank describes an internal compliance hold without citing any law, it may be the bank's own decision while it reviews your account.
Can I open a new account at another bank while mine is frozen?
Ask a lawyer first. An AMLA freeze on one account does not by itself stop you opening accounts elsewhere, but some banks may refuse if your name is flagged. Moving money to get around a freeze can cause further trouble.
