Who can restrict your account in Malaysia?

Three different parties can restrict your account: the police, an enforcement agency or the Public Prosecutor under AMLA, or your bank’s own compliance team. Each one uses a different law, lasts a different time and is lifted in a different way.

So the first step is to find out which one you have. A bank compliance hold may be cleared by sending documents. A police freeze needs a legal process.

The police freeze: CPC Section 116D

Under the 2024 amendments, police officers of sergeant rank and above can freeze a bank account immediately under CPC Section 116D. [f1] They do not need a court order. The freeze starts as soon as the police tell the bank.

A police freeze can block money going in and out, so you may not be able to withdraw, transfer or receive funds. It stays until it is lifted, varied through a legal process, or lapses.

It can come up in mule account investigations. If the police call you about your account, what you do in the first hour matters.

The AMLA freeze: Public Prosecutor, Section 50

Under AMLA Section 50, the Public Prosecutor has a separate power to order banks to freeze accounts suspected of holding money from crime. [f3] This covers money laundering, terrorism financing and other proceeds of crime.

An AMLA Section 44 freeze lapses after 90 days unless the person is charged. Under Section 52A, a Section 50 order lapses if the person is not charged within 18 months. If an enforcement agency froze the account under AMLA Section 44, you can apply in writing to that agency under Section 44A to release money for essential living expenses. [f5]

Challenging an AMLA freeze follows a different process from a police freeze. A lawyer who handles AMLA cases can tell which process applies and prepare the right application.

The bank compliance hold

Banks in Malaysia can restrict an account themselves under their account terms and their duties under the Anti-Money Laundering Act 2001. [f4] This is the bank’s own internal check, not a police or government order.

A bank compliance hold has no fixed length. [f2] The compliance team reviews your account and may ask for proof of income, where the money came from, or an explanation of certain transactions.

Read more about how bank compliance holds work and which documents to prepare. A hold may be cleared with clear records and no court case.

How to tell which restriction you have

The fastest way is to call your bank and ask three questions. Is my account restricted? Which authority or department restricted it? Is there a reference number?

If the police or the Public Prosecutor issued it, the bank will have a reference to the order. If it is the bank’s own review, the compliance department will tell you which documents it needs.

Failed transactions can also give a clue. A payment returned with a message such as “account blocked” or “refer to bank” may point to a freeze. A hold message from the bank’s own system may point to a compliance review.

What to do for each type

For a bank compliance hold, contact the bank’s compliance department. Send recent bank statements, proof of income and anything that explains the transactions under review. How long it takes depends on the bank. [f2]

For a police freeze under CPC Section 116D, a lawyer can help. A lawyer can write to the investigating officer, or apply to the Sessions Court to vary or revoke the order. Finding the right lawyer matters here.

For an AMLA order under Section 50, which is made by the Public Prosecutor, a lawyer can ask the Public Prosecutor to vary or revoke it. Section 44A does not apply to it, because it covers only a Section 44 freeze by an enforcement agency. [f5] A request for money for essential living expenses must state the exact amounts and what they are for.

What not to do

Do not open a new bank account to receive your salary or business income. The authorities may see this as trying to get around the investigation, which creates new legal problems.

Do not ignore a bank’s request for documents. Banks must report suspicious activity under AMLA Section 14, and an unanswered request may add to the bank’s concerns.

Do not assume a bank hold means you are under criminal investigation. A compliance review is part of a bank’s routine duties. Sending the right documents quickly is the best way to respond.

When do you need a lawyer?

A bank compliance hold may not need a lawyer. Sending the documents the bank asks for may be enough.

A police freeze or AMLA order is different, because it is part of a criminal investigation with its own time limits and steps. A qualified lawyer who handles frozen accounts can confirm who issued the order and prepare the applications.

If you are not sure which restriction you have, a lawyer may be able to tell once they hear what happened. The first steps after finding a freeze are the same for every type: confirm it, keep records, and get advice.

How do I find out if my freeze is from the police or the bank?

Call your bank and ask. The bank knows whether the restriction came from a police order under CPC Section 116D, an AMLA order from the Public Prosecutor, or its own compliance review. Ask for a reference number and the name of the authority that issued it.

Can a bank freeze my account without police involvement?

Yes. Under their account terms and their anti-money laundering duties, banks can restrict an account for compliance reasons. This is an internal hold, not a police or AMLA freeze. It often ends once the bank is satisfied with the documents it asks for, but no time is fixed.

Is a police freeze harder to remove than a bank hold?

Yes. To challenge or change a police freeze under CPC Section 116D, you apply to the Sessions Court. A bank compliance hold can often be cleared by contacting the bank's compliance department and sending supporting documents.

Can the police freeze my account without telling me?

Yes. Under CPC Section 116D, the police do not have to tell you before they freeze your account. Some people only find out when a payment fails. Your bank can confirm whether a police order exists.

What should I do first when I discover my account is restricted?

Call your bank to confirm the type of restriction and who issued it. That decides your next step: a bank hold needs documents, a police freeze needs legal advice. Do not try to move money to another account.
