What does NFA (no further action) mean?

NFA stands for no further action. The authorities have decided not to take the case against you any further for now. That is good news, but it is not the same as a court finding you innocent.

What NFA decides and what it leaves open

NFA is a decision not to charge you, or not to continue the investigation, for now. The authorities make it, not a court, so it is not an acquittal [f2].

A court acquittal comes after a trial. NFA only means the case is not going forward at this point. Ask for the NFA to be confirmed in writing so you have a clear record.

What NFA means for a frozen account

Getting a frozen account released is a separate step. It does not happen just because no further action is taken. A seizure order under AMLA section 52A lapses 18 months after it is made if no one is charged [f1].

If your account is still frozen after you are told NFA, check rather than assume. A lawyer can confirm the position with the bank and the investigators and ask about releasing your money.

Who handles these cases

Mule-account cases are investigated by the Commercial Crime Investigation Department (CCID or JSJK) at Bukit Aman [f2].

Under Article 5(3) of the Federal Constitution, you keep the right to consult and be defended by a lawyer of your choice, including if the case comes back later [f3].

Do not confuse NFA with court terms

Once a charge has been filed, you may hear other terms, such as a discharge not amounting to an acquittal. That happens in court, after a charge. NFA comes earlier, before any charge, so the two are not the same.

If you receive any official letter about your case status, keep a copy and show it to a lawyer. Legal terms can be confusing, and a lawyer can tell you what yours actually means.

If I get NFA, does that mean I was found innocent?

No. NFA means the authorities are not taking the case further for now, which is not the same as a court finding you innocent [f2]. It is a decision not to charge or continue, not a verdict. It is good news, but get it confirmed in writing so you have a clear record.

Will my frozen account be released if I get NFA?

Not automatically. Releasing the account is a separate step. A seizure order under AMLA section 52A lapses 18 months after it is made if no one is charged [f1]. If your account stays frozen after an NFA, get advice on confirming your position and asking for the release.

Can a case be reopened after NFA?

It can, if new evidence comes up, because NFA is a decision not to go ahead now, not a final acquittal [f2]. Keep your records and any written confirmation. If the matter comes back, you still have the right under Article 5(3) to consult a lawyer [f3].
