Passport Impound in a Criminal Case

When a court or authority impounds your passport, that differs from surrendering it as bail.

What impound means

Impound means a court or authority takes your passport and holds it because of a case. Once it is impounded, you no longer control the document.

The aim is to stop travel while the case is investigated or heard. It limits your movement; it is not a punishment.

In mule-account cases, this can happen when there is a worry you might leave the country. It says nothing about guilt.

Impound versus handing it in for bail

People can mix up two things. Handing in your passport as a bail condition is something you do yourself, to meet the terms of your release.

Impound is the passport being taken and held because of the case, which can go beyond a bail condition. Either way you have no passport.

But the reason, and the way to get it back, can differ. Check with a lawyer exactly why your passport is being held before you plan anything.

Impound is not a travel ban

A travel ban puts your name on a list that stops you at the border, but leaves the passport with you. Impound takes the passport itself.

A case can involve impound, a ban, both, or neither. They are separate controls with the same effect: you cannot leave.

Mixing them up wastes time, for example by applying to the wrong office. Confirm which one applies so any application goes to the right place.

Why travel is controlled in these cases

Mule-account cases can move fast. A police officer of Sergeant rank or above can freeze an account straight away under section 116D of the Criminal Procedure Code [f1], and limits on the person can follow.

A more serious alleged offence can raise the worry that someone will leave. Section 424B, for example, carries a fine of RM10,000 to RM100,000, or 1 to 7 years jail, or both [f2].

Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f4]. Someone under these controls may still only be under investigation, not convicted.

Getting your passport released or returned

If you genuinely need to travel, do not just try to leave. A lawyer can apply to the court or authority to release the passport for a set purpose and set dates.

The answer depends on the facts of your case. Make the application early, with an honest reason, rather than at the last minute.

When the case ends, the passport may be returned or its release ordered. Keep any receipt or record of the impound so you can ask for it through the right channel.

Your right to a lawyer

Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice [f3].

A lawyer can confirm why the passport is held, apply for any release you need, and follow up if the return is delayed. Keep your case papers and the impound record together so this goes faster.

Planning around the impound

While the passport is held, put off travel that is not urgent. If you have work abroad or a family event overseas, tell your lawyer early, because an early application gives your lawyer time to prepare.

Do not apply for a new or replacement passport to get around the hold. It can look like you are trying to dodge the control.

The impound is tied to the case, not a verdict about you. It can change as the case moves, so deal with it step by step with your lawyer.

What does it mean to have a passport impounded?

Your passport is taken and held by a court or authority because of a case, so it is out of your hands. It controls travel; it is not a punishment by itself. A travel ban is different: it flags your name but leaves the passport with you.

How is impound different from surrendering my passport for bail?

With bail, you hand in the passport yourself to meet a condition of your release. With impound, the passport is taken and held because of the case, which can go beyond a bail condition. Either way you have no passport, but the reason and the way to get it back can differ.

Can I get an impounded passport back for a genuine trip?

Sometimes. A lawyer can apply to the court or authority to release it for a set purpose and set dates, such as urgent work or a family emergency. The answer depends on your case, so apply properly and early; never try to travel around the hold.

When do I get my passport back for good?

It may be returned when the case ends or when a court or authority orders its release. Keep any receipt or record of the impound so you can ask for it through the right channel. If the return is delayed after the case ends, a lawyer can follow it up.
