Remand: What to Expect
If police apply to remand you in a mule-account case, here is what the process looks like.

What remand means
Remand is detention ordered by a Magistrate so police can finish investigating. It is not a punishment and not a conviction. It gives investigators time to complete enquiries while the suspect is held.
In mule account cases the file is handled by JSJK, the Commercial Crime Investigation Department at Bukit Aman [f1]. They may ask how money moved and who controlled the account.
The hardest part can be not knowing how long it will last or what comes next. Remand is a legal step with limits, not open-ended detention.
Why remand happens in these cases
Money in a suspected mule account can move fast, and accounts can be frozen at once. Under CPC s116D, a police officer of Sergeant rank or above can freeze an account on suspicion without a court order [f3].
Investigators may also ask for remand so they can question a person and trace transactions. This does not mean you are guilty, and some people are released without charge.
The hearing before a Magistrate
Police must bring you before a Magistrate to ask for remand. The Magistrate hears the request, weighs what the investigation really needs, and may give fewer days than police ask for.
This hearing is where the length of detention is decided, so it is more than a formality. If police ask for more days than the case needs, that can be challenged on the spot.
Your right to a lawyer
Even in detention, Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice [f2]. Ask for it plainly.
A lawyer can attend the remand hearing, argue for fewer days or release, and check that your welfare is respected. Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f4], so these cases are common enough that lawyers see them regularly.
What your family can do
While you are held, your family is your link to the outside. They should note where you are held, contact a lawyer at once, and keep their phones on so the lawyer can reach them.
They can also collect documents: your IC, an employment letter, and any chats that show you were deceived.
While you are held
Look after your basic needs and tell the officers clearly about any medical need. As far as you can, remember the names of anyone who questions you and the dates. These details can matter later.
After remand ends
When remand ends, one of three things happens. You are released without charge, released on bail with conditions, or brought to court to face a charge.
Whatever comes next, clear records and a lawyer who already knows your case make it easier to face.
If a family member faces remand
The first hours can be chaotic. Start by finding out exactly where the person is held and which police district is handling the case.
Contact a lawyer as early as you can, so the lawyer can attend the remand hearing itself. That is where the length of detention is decided, and having someone there to argue for fewer days helps [f2].
Write down the names of officers you speak to and the times. Pass all questions through the lawyer instead of acting on rumours. If this is happening to your family now, send us a WhatsApp message and we can refer you to a lawyer.

Is remand the same as being charged?
No, remand is detention ordered by a Magistrate so police can finish their enquiries. Being charged is a later, separate step where the accusation is read in court. Some people are remanded and then released without charge.
How long can remand last?
The Magistrate decides. For these offences the limit is up to 4 days at first and up to 3 more on a second application. Police ask for a number of days, and the Magistrate may give fewer. A lawyer at the hearing can argue for a shorter period or for release.
Can I speak to a lawyer during remand?
Yes, you have a constitutional right to consult a lawyer of your choice. Ask for it clearly and give your family a way to arrange one. The lawyer can attend the remand hearing, check on your welfare and advise you on the questions you face.
What should my family do while I am remanded?
Contact a lawyer quickly, note where you are held, and gather your IC, employment letter and any proof that you were tricked. Being organised and reachable lets the lawyer act fast.
