I am a student accused of being a mule. What now?

Mule recruiters can target students, with easy-money offers online or through people they know. What you knew and why you handed over the account matter to your defence. Being a student does not change the offence.

What the law punishes

A student who sold or lent an account may face section 424B. It punishes handing over control of your own account to someone else. The penalty is a fine of RM10,000 to RM100,000, 1 to 7 years in jail, or both [f1].

Being young, short of money or unaware of how the account would be used does not by itself cancel the offence. But a defence will consider these facts, because what you knew and why you acted matter.

Check whether your account is flagged

The PDRM Semak Mule portal lets you check whether an account or phone number is flagged as a mule. Recent reports show more than 190,000 accounts flagged [f2]. Checking early tells you where you stand before anyone contacts you.

If your account is flagged, stay calm. Gather records of how the account was opened and used. Write down who approached you and what they promised.

Getting help on a tight budget

Under Article 5(3) of the Federal Constitution, you have the right to see and be defended by a lawyer of your choice [f3]. That right does not depend on how much you earn.

If cost is a real problem, the Legal Aid Department may give help at low or no cost to people whose income qualifies [f4]. Ask about it early, so you do not face police questions alone.

What to do now

A student accused of being a mule is not automatically guilty. Your defence depends on what you knew, how you were recruited and what your records show [f1].

Check the Semak Mule portal and keep your evidence. Get advice before you give a detailed statement. A lawyer can tell you which section you may face and help you prepare.

I sold my account for quick cash because I was broke. How serious is that?

Handing over control of your own account is the offence in section 424B. The penalty is a fine of RM10,000 to RM100,000, 1 to 7 years in jail, or both [f1]. Being a student short of money does not cancel the charge. But a defence will look closely at all the facts, including how you were recruited.

How do I even know if my account is flagged?

The PDRM Semak Mule portal lets you check whether an account or phone number is flagged as a mule [f2]. Checking early tells you where you stand before anyone contacts you. If it is flagged, stay calm, gather your records and get advice on what to do next.

I cannot afford a private lawyer. What are my options?

Under Article 5(3) you still have the right to see and be defended by a lawyer of your choice [f3]. If cost is a problem, the Legal Aid Department may give help at low or no cost to people whose income qualifies [f4]. Ask about this early, so you do not face police questions alone.
