Foreign Worker's Account Used Without Permission?
Your employer or agent used your bank account for transactions you did not agree to.

Why foreign workers can be targeted
Foreign workers in Malaysia can be targets for mule account syndicates. Your work permit depends on your job, your employer has power over you, and you may not know the language or Malaysian law well. [f4]
It can start with an employer, agent or co-worker asking to use your bank account. The request may come with pressure: hints about your work permit, promises of extra money, or simply an order from someone you depend on. You may feel you cannot say no.
Your account is then used to receive and send money linked to crime. When the money is traced, your account shows up in the investigation. The person who pressured you may be gone.
You have the same rights as a citizen
Foreign workers in Malaysia have the same rights in a criminal case as Malaysian citizens. [f1] You can have a lawyer, ask for an interpreter and expect a fair investigation.
Section 424B of the Penal Code applies to everyone in Malaysia. [f2] The penalty for giving someone control of your account is the same whatever your nationality. So are the defences, including the knowledge element (what you knew) and your right to a lawyer.
Your immigration status does not reduce your legal protection. An investigation gives no one the right to mistreat you. You are entitled to understand the charges and the process in a language you speak.
What happens to your work permit
An investigation does not cancel your work permit automatically. [f3] Your right to work here depends on how the investigation ends and whether you are charged.
If you are investigated but not charged, your permit may stay valid. If you are charged, things get more complicated, and a lawyer can explain what it means for your immigration status. Getting advice early lets your lawyer handle the criminal case and the permit together.
Do not let fear of losing your permit stop you from getting help. Ignoring the investigation will not make it go away.
Pressure from your employer matters to your defence
If your employer or agent pressured you into giving them your account, that can support your defence. A person who depends on someone may not truly agree to what they go along with.
Your lawyer will look at your relationship with the person who used your account. Did they control your job? Did they threaten your permit or your housing? Did they take your banking details without your real agreement?
Evidence of pressure includes messages, statements from co-workers and the way the account was used. If your employer held your ATM card or password as part of your job, that can show you did not take part willingly.
What to do now
Stop giving access to your account. Change your passwords, get your ATM card back if you can, and stop following instructions from whoever used the account. Your safety comes first.
Keep all evidence. Keep messages from your employer about the account, your employment papers, your work permit and your salary records. Do not delete anything, even messages that seem unimportant.
Get a lawyer. [f5] Legal help is available for foreign workers in Malaysia.
The Legal Aid Department and YBGK help Malaysians. Non-citizens can ask a Bar Council Legal Aid Centre. You can also go to a private lawyer who handles mule account cases.
If you are not a Malaysian citizen, the Legal Aid Department is not your route. Your next step is to contact Tenaganita or your nearest Bar Council Legal Aid Centre, say you are a foreign worker with a frozen account, and ask whether they can help you.
Ask for an interpreter. If police contact you, you can give your statement in a language you understand. Do not sign anything you cannot read. Ask for an interpreter and wait for one.
Do not run away. Leaving Malaysia during an investigation can look like guilt and may lead to a warrant for your arrest. Stay, deal with the authorities through your lawyer, and let your lawyer do the talking.
Getting legal help as a foreign worker
You may worry that a lawyer costs too much, or that lawyers do not help foreign workers. Ask about fees before you agree to anything. Some private lawyers who handle mule account cases act for foreign workers. [f5]
Your embassy or consulate may have a list of lawyers who speak your language. It can give consular help while your lawyer handles the case.
Doing nothing carries its own risk, because the investigation goes on without your side being heard. A lawyer can build a defence around your situation, the pressure you faced and the evidence that you did not choose to take part in crime.

Can I be charged even though my employer controlled my account?
The offence is giving control of your own account to someone else without lawful authority or lawful purpose. If your employer took control without your real agreement, that matters to your defence. What you knew and the pressure you were under also matter, and a lawyer can set them out.
Will I be deported if my account is investigated?
An investigation does not lead to deportation automatically. Your immigration position depends on whether you are charged and how the case ends. Getting a lawyer early helps protect both your case and your right to stay during the investigation.
I do not speak Malay or English well. Can I still get legal help?
Yes. You can ask for an interpreter during police questioning, and courts use interpreters. A lawyer can help arrange an interpreter so you understand your rights.
My employer threatened to cancel my work permit if I did not cooperate. What can I do?
Threats from your employer matter for your defence and may be offences themselves. Save any evidence of them: messages, recordings or co-workers who heard them. A lawyer can use this to show you were pressured.
Can a foreign worker get legal aid?
The Legal Aid Department and YBGK help Malaysians. Non-citizens can ask a Bar Council Legal Aid Centre. A lawyer can tell you whether you qualify.
What happens to my salary if my account is frozen?
A frozen account blocks everything, including salary coming in. Ask your employer to pay you another way, such as into another account in your own name. A lawyer can advise on this and, in some cases, apply to release part of the frozen money.
Should I tell my embassy about the investigation?
You have the right to contact your embassy, and it can give consular help. Speak to a lawyer first about when to contact it and what to say. Your embassy can help in practical ways but cannot step into Malaysian court proceedings.
