What is the Evidence Act 1950?
The Evidence Act 1950 is the Malaysian law that decides what a court may accept as evidence and how much weight it carries. It covers documents, witness testimony and statements given during an investigation. It does not create offences; it governs proof.
In a frozen-account or mule-account case, it decides whether something can be used in court. It works with the Penal Code, which defines the offences, and the Criminal Procedure Code, which sets the steps of the process.
Why does admissibility matter?
Admissibility asks whether a piece of evidence is allowed at all. If it is not admissible, the court does not rely on it. If it is, the court can weigh it for or against you.
Mule-account cases are investigated by the CCID at Bukit Aman. What the police collect still has to meet the Act’s rules before a court will count it. [f2]
What about statements and confessions?
The Act and the Criminal Procedure Code have rules on when a statement or a confession can be used in court. The rules are technical and have exceptions. Voluntariness runs through them: a statement obtained by threat, inducement or promise can be challenged.
So what you say, and how it is recorded, matters a great deal. Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice. [f1]
Is what I tell my lawyer kept private?
In general, an advocate cannot reveal what you tell them for the purpose of getting legal advice unless you agree. This does not cover plans to commit a crime.
Why is this relevant to you?
Mule accounts are a large enforcement area: police detected 46,048 mule accounts in 2023 and 50,295 in 2024. [f3] In a case that reaches court, the Evidence Act helps decide what proof stands.
The stakes are real. Penal Code section 424A carries a fine of RM5,000 to RM50,000, or 6 months to 5 years in prison, or both. [f4] With legal help, you can prepare before you speak.

What does the Evidence Act do?
The Evidence Act 1950 sets the rules for what a Malaysian court may accept as evidence and how much weight it gets. It covers documents, witness testimony and statements. In a mule-account case, it helps decide whether things like your bank records or a recorded statement can be used against you.
Does the Evidence Act decide if my statement can be used?
Partly. This Act and the Criminal Procedure Code both have rules on when a statement or confession can be used in court, and whether it was given voluntarily is a key question. The rules are technical and have exceptions. A statement obtained by threat, inducement or promise can be challenged. That is why it helps to get legal advice before you give one.
Why does admissibility matter to me?
A case turns on what evidence the court can rely on. Evidence ruled inadmissible is not used against you. Evidence ruled admissible can count. A lawyer can tell you which is which, so you know what to say, what to keep and how to respond at each stage, from questioning to trial.
