When a freeze cuts off money you need for care
A frozen account is hard for anyone. If you live with a disability and pay for care, medicine or transport from that account, the freeze can hit your daily life straight away.
The freeze has a time limit
A freeze under AMLA is not permanent. A section 44 freeze ends after 90 days if you are not charged. Under AMLA s52A, a seizure order lapses 18 months after it is made if you are not charged and no prosecution starts [f2].
That does not pay this month’s bills. It does mean the situation has an end point.
You also have the right to legal help. Article 5(3) of the Federal Constitution lets you consult and be defended by a lawyer of your choice [f3].
Asking for money to be released for care and living costs
If the account was frozen under AMLA s44, you can apply in writing to the agency that froze it. Under AMLA s44A, that agency can vary the freeze to release money for reasonable living expenses [f1]. No court is involved.
Care, medicine, therapy, mobility aids and daily needs are the kind of costs to list. Show what you pay each month and why you cannot do without it.
A lawyer can prepare this written application for you and attach the right proof. If the freeze came from the police under a different law, the route is different, and a lawyer can tell you which one applies.
Getting support to deal with the process
Forms, letters and police visits can be hard to manage. A family member, carer or someone you trust can help you collect papers and speak to the bank or police with you.
You can ask officers for more time, for help with paperwork, or for each step to be explained slowly or in writing. Asking for this is reasonable.
If you cannot afford a lawyer
The Legal Aid Department (Jabatan Bantuan Guaman) may give legal help at low or no cost to people who meet its income test [f4].
Contact them early. Tell them about your care needs, because that shows why the freeze is urgent for you.
Papers to keep
- Receipts or bills for care, medicine, therapy and transport.
- Any letter or notice about the freeze, and the date you found out.
- Bank statements and messages from the bank or police.
- Medical letters that show your condition and what support you need.
If sorting papers is hard, ask someone you trust to put them in date order. A tidy set of papers can help a lawyer act faster.
What to do next
Write down what was frozen, when, and which care costs the account pays for. Then get advice on whether money can be released for those needs.
A lawyer can check which law froze the account and make the application on your behalf. You can send us the details by WhatsApp and we can refer you to a lawyer.

My account is frozen and I pay for my care from it. Can any money be released?
Possibly. Under AMLA s44A you can apply in writing to the agency that froze the account to release money for reasonable living expenses. No court is involved. A lawyer can write the application and attach proof of your care and medicine costs.
Does a freeze last forever?
No. A section 44 freeze ends after 90 days if you are not charged, and under AMLA s52A a seizure order lapses 18 months after it is made if you are not charged and no prosecution starts. That limit does not help with this month's bills, so it is still worth asking for living expenses now.
