Foreign Worker Rights in a Frozen Account Case
A foreign worker whose account is frozen keeps the same legal rights as anyone in Malaysia.

Your rights do not depend on nationality
If you are a foreign worker in Malaysia and your bank account is frozen, you may think you have fewer rights than a citizen. On the most important protection, you do not.
Article 5(3) of the Federal Constitution gives the right to consult and be defended by a lawyer of your choice [f1]. It is not limited to citizens. It protects anyone questioned in a criminal case.
For the general list of protections, read account holder rights.
How workers get pulled into mule cases
One way is account sharing. Someone offers a worker money to use their bank account, or asks for the card and PIN, and says it is harmless.
It is not harmless. Giving control of your own account to someone else is an offence under Penal Code section 424B. It carries a fine of RM10,000 to RM100,000, or 1 to 7 years in jail, or both [f2].
The offer can look like easy money. Say no, even to friends or agents you trust.
Why the freeze can come without warning
Under Criminal Procedure Code section 116D, a police officer of Sergeant rank or above can freeze an account without a court order [f4]. A worker can find their salary account frozen with no notice.
That is frightening when your wages, money sent home and daily costs all go through one account. A freeze is a step in an investigation; it does not prove you did anything wrong.
Time limits in the law
An AMLA order that freezes or seizes your money lapses 18 months after it was made if you have not been charged [f5]. A freeze by an enforcement agency under section 44 lasts up to 90 days unless you are charged.
This matters if your contract or permit runs for a fixed term. A lawyer can track the dates and ask the authorities which order applies to you.
Getting help when money is tight
Do not face police questions without advice just because of cost. The Legal Aid Department (Jabatan Bantuan Guaman) helps Malaysian citizens who meet its income test, and non-citizens can ask a Bar Council Legal Aid Centre [f3].
If you are not a Malaysian citizen, the Legal Aid Department is not your route. Your next step is to contact Tenaganita or your nearest Bar Council Legal Aid Centre, say you are a foreign worker with a frozen account, and ask whether they can help you.
Ask about it early. Even if you later need a private lawyer, legal aid can explain your position and the process. The guide on finding legal help compares your options.
What to do first
- Do not let anyone else use your account, card or banking details.
- Keep the freeze reference, bank letters and your work documents together.
- Get advice before you give a statement.
- Ask for an interpreter if you need one, so nothing is misunderstood.
If you have been arrested or expect to be, read what happens after arrest.
Handling the money side
A frozen account stops wages, rent and money sent home all at once. Tell your employer what has happened in plain facts, and ask what they can arrange for your pay.
Tell your family back home, so a missed transfer does not cause worse fear. Never accept an offer to move money through someone else’s account to fill the gap. That turns one problem into a bigger one.
A lawyer can explain your rights and what to do about the freeze. Send us your details by WhatsApp and we can refer you to one.

Do foreign workers have the right to a lawyer here?
Yes. Article 5(3) of the Federal Constitution gives the right to consult and be defended by a lawyer of your choice, and it is not limited to citizens. If police question you about a frozen account, you can ask to speak to a lawyer before you give a statement.
How do foreign workers end up in mule-account cases?
Some are pulled in through account sharing. Someone offers a fee to use your bank account, or asks for your card and PIN, and says it is harmless. Giving control of your own account to someone else is an offence under Penal Code section 424B.
Is there legal help if I cannot afford a lawyer?
There may be. The Legal Aid Department (Jabatan Bantuan Guaman) helps Malaysian citizens who meet its income test, at low or no cost. Non-citizens can ask a Bar Council Legal Aid Centre. Ask early, before you are questioned.
Will a frozen account affect my work permit?
A freeze is a banking and police matter, not automatically an immigration one. A criminal charge, though, can affect your status. Get legal advice early so you understand both before making decisions about work or travel.
