JSJK or CCID contacted me. What should I do first?

Talk to a lawyer before you reply. If JSJK or CCID has called, messaged or sent a letter about your bank account, now is a good time to get advice. What you say first can shape what follows.

This applies whether you think your account was misused, you are a student unsure how serious this is, or you have been told to come in. In each case the first step is the same.

What JSJK or CCID investigates

CCID, called JSJK in Malay (Jabatan Siasatan Jenayah Komersil), is the police Commercial Crime Investigation Department. It is one of the units that can contact people about mule account and scam cases. ^[f1] Contact may be a phone call, a WhatsApp message or a letter asking you to attend a station.

You may not be under arrest. The questions can cover your bank account, how it was used and who could access it. A lawyer helps you think these through before you answer.

Getting help in Mandarin, not just English

Explaining a legal problem in a second language adds stress you do not need. If Mandarin, Cantonese or another Chinese dialect is easier, say so in your first WhatsApp message.

This helps parents and older relatives supporting a younger family member. It also helps anyone who thinks more clearly in their first language under pressure.

What a lawyer does before you respond

A lawyer first looks at the contact you have had and what you remember about how the account was used. They then explain which offence the questions are likely about: sections 424A, 424B or 424C. All three are bailable, so bail is a right, with the court or police setting the amount and conditions. Each can lead to a fine or jail. ^[f4]

If you are arrested, Article 5(3) of the Federal Constitution says you shall be allowed to consult a lawyer of your choice. ^[f2] Before an arrest you can still ask to speak to a lawyer first, but you have no right to have one in the room. ^[f3]

The aim is not to script your answers. It is to let you reply with a clear head instead of guessing.

What happens to your account

JSJK or CCID contact can come with, or just before, action on your bank account. A police officer of Sergeant rank or above can freeze an account and block transactions at once under CPC section 116D, with no court order. ^[f5]

If you cannot afford a private lawyer

Cost should not push you to reply to JSJK or CCID unprepared. The Legal Aid Department (JBG) and the National Legal Aid Foundation (YBGK) offer legal aid to eligible Malaysians. YBGK covers criminal cases at arrest, remand and bail, and at trial subject to a means test. ^[f6] Check their rules to see if you qualify.

What to send on WhatsApp

Send a short message saying what JSJK or CCID told you, how they contacted you, and when you must reply. Say if you would rather write in Mandarin or Cantonese.
