What mens rea means in a mule account case

Mens rea is the legal term for the “guilty mind”: the knowledge or intention behind an act. Lawyers call the physical act itself the actus reus.

In a mule account case, this difference is practical. Letting someone else use your account is one thing. Knowing or intending that it would carry scam money is another. Mens rea is that second part.

Someone who never touched the money or met the people who used it can still be charged. Their case may turn on what was in their mind at the time.

Why what you knew matters

Money passing through your account does not tell the whole story. What you knew and why you acted can matter to your defence.

Take section 424B, which punishes giving control of your own account to someone else without lawful authority or lawful purpose. It carries a fine of RM10,000 to RM100,000, or 1 to 7 years in jail, or both [f1]. Handing over access shows in the records. What you knew and why you did it are harder to see, and a defence looks closely at them.

The same applies to section 424A, which covers holding someone else’s account or card without lawful authority [f2]. Having it may be clear, but what you knew and how you came to have it are separate questions.

How a court works out what you knew

No court can see inside your head. It works backwards from the facts around the act and draws conclusions about your state of mind.

It weighs what you were told when you handed over the account, whether you were paid, how the arrangement was explained, and how a reasonable person in your place would have seen it. No single fact decides the case, but together they build a picture.

That is why the messages, receipts and job adverts you kept matter. They show the story you were actually given and what you truly believed.

Where deception changes the picture

Some of these cases start with a lie. A person is told the account is for a salary, a part-time job, business cash or a favour for a friend. They act on that lie with no sense of doing wrong.

If that is truly what happened, it goes straight to what you knew and why you acted. Someone tricked into handing over an account did not share the purpose of the people who tricked them.

Deception does not decide the outcome on its own. But it is exactly the kind of fact a defence puts forward. A lawyer can look at your messages and tell you how strong that point is in your case.

Why keeping evidence matters for intent

Because the case can turn on what you knew, evidence of your state of mind becomes central. That evidence can be ordinary and easy to lose.

Keep screenshots of the chat that led you to open or hand over the account, the job advert, the promises about payment, and a timeline of when you first suspected something was wrong. Save them now, before a phone is reset or chats disappear.

Police detected 46,048 mule accounts in 2023 and 50,295 in 2024 [f4], but each case depends on its own facts, including what the person charged knew.

A charge is not a finding

A charge is an allegation, not a finding. The prosecution must still prove its case.

What does mens rea actually mean?

Mens rea is Latin for "guilty mind": the knowledge or intent behind an act. In a mule account case, what you knew and why you acted can matter to your defence. Section 424B covers giving control of your own account to someone else without lawful authority or lawful purpose [f1].

If I did not know, does that help me?

It can help. What you knew and why you handed over the account matter to your defence. What you were told and how you were tricked are examined. Keep every message and get advice early [f3].

How does a court look at what I knew?

A court cannot read minds, so it works it out from the facts around you. Your messages, the story you were given, any payment for the account, and how quickly you acted are all weighed [f1]. Keep records that show what you believed.

Does being charged mean the prosecution has already proved intent?

No. A charge is an allegation, not a finding, and the prosecution must still prove its case at trial. Under Article 5(3) you can be defended by a lawyer of your choice [f3], who can test the evidence, including what it shows about what you knew.
