Punishment and repair

Criminal justice asks how an offender should be punished. Restorative justice adds a second question: how can the harm be accepted and, where possible, put right?

Nothing here promises an outcome.

What restorative justice means

Restorative justice puts the people hurt by an offence at the centre, not just the court process. It values accepting what happened, taking responsibility and making repair.

In practice, that can mean recognising how the victim was affected and taking responsible steps in response. How far it applies in your case depends on the law and your facts. It is a way of thinking, not a shortcut around the criminal process.

What it cannot do

Restorative justice does not override the criminal law, and it cannot promise any outcome. False hope would only add to the harm.

The offences can be serious. Penal Code s424B, giving someone else control of your own account, carries a fine of RM10,000 to RM100,000, or one to seven years in jail, or both [f1]. Section 424C is more serious still, with up to ten years in jail [f2].

These penalties are set by law. Repair does not make a charge disappear; at most it sits alongside the formal process.

Where repair can count

Courts weigh many things when deciding a sentence. How you behaved after the event can be part of mitigation, the reasons a court hears for a lighter sentence.

Honest cooperation, openness and, where it fits, helping to repair harm can reflect well on you. None of this is certain, but it can count.

Take these steps carefully and on advice. Acting in a panic, such as paying money without a record, can make things more complicated.

If you were tricked

Some account holders were genuinely tricked into giving access to their account. That matters a great deal, and talking about repair does not erase it.

If you did nothing wrong, the main task is to show that clearly. Article 5(3) of the Federal Constitution gives you the right to consult and be defended by a lawyer of your choice [f4].

Thinking about repair is not admitting guilt. A lawyer can help you judge whether it fits your facts or whether another approach suits you better.

Acknowledging harm the right way

Where a victim lost money, proper acknowledgement can start with the loss being reported and recorded. That creates an honest, formal trail.

Victims can report scams to the National Scam Response Centre on 997, which can trigger urgent freezes [f3]. A clear record helps everyone see what really happened.

Any step you take after that should be written down and guided by a lawyer. That protects your own position and shows real responsibility.

Repair and defence can go together

Repairing harm and defending yourself are not opposites. Your defence makes sure the case against you is properly tested. Repair, where it fits, shows how you treat the people affected.

If you are unsure how the two fit together in your case, send us a WhatsApp message. We can refer you to a lawyer who handles mule account cases.

What is restorative justice, in simple terms?

It is a way of dealing with an offence that looks at repairing the harm, not only at punishment. It can mean accepting the effect on the people hurt and taking responsible steps in response. How far it applies depends on the law and the facts of your case.

Can restorative justice make my charges disappear?

No, it does not override the criminal law and cannot promise any outcome. Honest cooperation and helping to repair harm can sometimes count in mitigation, the reasons a court hears for a lighter sentence. A lawyer can tell you where it fits in your case.

I was tricked, so does repairing harm apply to me?

Some account holders were genuinely deceived, and that matters a great deal. If you did nothing wrong, the focus is on showing that, and Article 5(3) of the Federal Constitution protects your right to be defended. Thinking about repair is not admitting guilt.

How is harm properly acknowledged?

It can start with the harm being reported and recorded. Victims can report scams to the NSRC hotline 997, which can trigger urgent freezes. Any step you take after that should be recorded and taken on a lawyer's advice, not in a panic.
