What an acquittal means

An acquittal means the charge against you did not succeed. The court did not find the case proved, and you are not convicted. It is the result you were working towards.

But relief on the day does not mean every loose end is tied off. A criminal charge sits alongside other matters, such as a frozen account, a flag on a checking tool and questions about records. These do not all resolve themselves when the verdict is given.

The aim is to follow a good result through, so nothing important is left hanging.

Frozen funds after the case

A freeze on an account is separate from the criminal charge. It has its own rules and its own timeline, so check its status after an acquittal.

A seizure or freezing order under AMLA section 52A lapses if you are not charged within 18 months [f1]. You can also apply in writing to the agency that froze the account, asking to release money for reasonable living or business costs under section 44A [f2]. A more senior officer decides.

After an acquittal, find out the current status of any freeze that remains and what is needed to move it forward. Do not assume it lifts the moment the case ends.

Flags and checking tools

A flag is separate again from the court and the freeze. The Semak Mule portal is a public tool that shows whether an account or phone number has been flagged as a mule.

More than 190,000 accounts have been flagged [f4]. A flag is not a conviction, and it follows its own process. After an acquittal, check your own status on the portal and ask how any flag can be dealt with.

Leaving it unchecked can cause trouble later, such as difficulty with banking. Treat it as its own task, not as something the acquittal cleared.

The records question

You may worry about what record remains. That is a reasonable concern, and it is better to understand it clearly than to assume the worst or the best.

An acquittal is a favourable outcome, but how records are treated depends on the circumstances and the law that applies. This is its own area, so ask for advice instead of guessing.

Keep your own copies of the court documents that show the outcome. It is a simple protection, whatever the records position turns out to be.

Why advice still helps after a win

It can feel odd to seek advice after a good result, but the follow-up is where things can slip. Frozen funds, flags and records each run on their own track, and each may need a specific step.

You have the right to consult a lawyer of your choice under Article 5(3) of the Federal Constitution, and that right does not end at the verdict [f3]. A lawyer can help you handle the aftermath cleanly, including whether any appeal could follow.

A short checklist

Write down what is still open. Note the status of any freeze, whether you have checked your flag, and where your court documents are kept.

Then work through it one step at a time: confirm the freeze, check the portal, keep your documents and ask about records and any appeal.

Does an acquittal end everything automatically?

An acquittal means the charge did not succeed, but it does not settle every practical matter at once. Frozen funds, flags and records may still need attention. It is a good result. Check each follow-up step instead of assuming it happens by itself.

What happens to my frozen account after an acquittal?

A freeze is separate from the charge, and it ends under its own rules. A seizure or freezing order under AMLA s52A lapses if you are not charged within 18 months [f1], and you can apply in writing about frozen funds under s44A [f2]. After an acquittal, ask a lawyer to confirm the status of any freeze that remains.

Will my name still show as flagged anywhere?

A flag on a checking tool is separate from the court result. The Semak Mule portal shows whether an account or phone number is flagged, and more than 190,000 accounts have been flagged [f4]. After an acquittal, check your own status and ask how any flag can be removed.

Can the prosecution appeal an acquittal?

Possibly. An acquittal is not always the final word, because an appeal route can exist depending on the case. Keep your documents and stay in touch with your lawyer, who you have the right to consult under Article 5(3) of the Federal Constitution [f3].
