Which Kuching court is involved?

The law is federal, but the court you attend is local. The offences under Penal Code sections 424A to 424C apply the same in Sarawak as anywhere in Malaysia ^[f1].

Court matters in Kuching are handled at the court complex at Jalan Gersik, Petra Jaya, 93050 Kuching ^[f5]. The High Court in Sarawak also sits in Kuching, among other towns ^[f6].

Reading your charge sheet and court letter

Your charge sheet or court letter names the court, the room and the date. Photograph it and keep the original.

The prosecution decides whether a Magistrates’ Court or Sessions Court hears the case. If the letter is unclear about which court, ask the registry or a lawyer before the date.

What happens at a first mention

A first mention is a short hearing, not a trial. The court fixes the next steps and may ask whether you have a lawyer.

Who investigated the case

Mule cases are investigated by the police Commercial Crime Investigation Department (JSJK), a national department ^[f4]. Kuching officers work within it.
