How a frozen account in Kuching gets unfrozen

If your account in Kuching is frozen, the first thing to know is how a freeze ends. There are two main ways.

The freeze can lapse when its time limit runs out. Or you can ask for part of the money to be released while it lasts. Which way fits depends on which law was used to freeze the account.

When an AMLA freeze lapses

An AMLA freeze has a time limit. Under section 50, the Public Prosecutor can order a freeze on money suspected to come from crime [f3].

Under section 52A, that order lapses after 18 months if no one is charged in that time [f1]. A freeze by an enforcement agency under section 44 ends sooner, after 90 days unless a charge is brought.

The bank may not lift the block the same day the order lapses. Keep your papers ready and follow up. The freeze duration guide sets out each time limit.

Asking for money for living costs

You do not always have to wait. If an enforcement agency froze the account under AMLA section 44, section 44A lets you apply to release money for reasonable living or business costs [f2].

You apply in writing to the agency, and a more senior officer decides. The answer is not automatic, so you need proof such as rent, loan and utility bills.

Applying does not stop the 18-month count. A lawyer can prepare the written request and the supporting papers for you.

Where a Kuching request goes

The request goes to whoever froze the account. For an agency freeze under section 44, that is a written request to the agency. For a police freeze under section 116D, a lawyer would apply to the Sessions Court [f4].

Court matters in Kuching are handled at the court complex on Jalan Gersik, Petra Jaya [f6]. Which court hears your request depends on the order, so ask a lawyer to confirm.

If cost is a worry, the Legal Aid Department lists a Sarawak office [f5]. It helps people who meet its income test and whose matter is covered, so ask what applies to you.

Bring the bank letter and any freeze reference. See also finding legal help for what to check in a lawyer.

How does a frozen account in Kuching get unfrozen?

There are two main ways. Under section 52A, a Public Prosecutor order lapses if no one is charged within 18 months [f1]. Before that, you may be able to ask the enforcement agency that froze the account under section 44 for money for reasonable costs, in writing under section 44A [f2]. Which way fits depends on which law froze the account.

Why would a freeze lapse on its own?

Because the law sets a time limit. A section 50 freeze order [f3] lapses if no one is charged within 18 months [f1]. The bank may not lift the block the same day, so keep your papers ready and follow up if it stays in place.

Can I get some money out before the freeze ends?

Sometimes. If an enforcement agency froze the account under AMLA section 44, section 44A lets you apply in writing to that agency to release money for reasonable living or business costs [f2]. A more senior officer decides, and you need proof of your bills. Applying does not stop the 18-month count.

Where do I send a release request from Kuching?

It depends on who froze the account. For an agency freeze under section 44, the written request goes to that agency, so use the address on its letter. For a police freeze under section 116D [f4], a lawyer would ask the Sessions Court, and can tell you which Kuching court hears it.

Can the Legal Aid Department help with a freeze?

It may, if you meet its income test and your matter is covered. It lists a Sarawak office [f5]. Ask early, and bring the bank letter and the freeze reference so staff can see which law was used.
