Where a Selangor mule charge is heard

The court named on your charge sheet hears the case. The prosecution decides whether a Magistrates’ Court or Sessions Court hears it.

After the charge, every mention and hearing is listed by the court that has your case. The court sets the dates, so your case moves at the court’s pace from first mention to trial.

Check the section on your charge sheet first

The most important line on your papers is the section number. The three mule offences carry very different penalties.

  • Section 424A, holding or controlling someone else’s account: a fine of RM5,000 to RM50,000 or up to five years in jail [f1].
  • Section 424B, handing over control of your own account: up to seven years [f2].
  • Section 424C, using an account for transactions with no lawful purpose: the heaviest, with 3 to 10 years in jail, or a fine of RM10,000 to RM150,000, or both [f3].

Our section 424B explained page covers the middle charge in detail.

From first mention to trial

Your first court appearance is a mention, not a trial. The charge is read, you say whether you plead guilty or claim trial, and bail can be dealt with.

More mentions follow while the two sides exchange documents. A case goes to trial if you claim trial. Our investigation and court process page sets out each step.

What helps a bail application

These charges are bailable, so you have a right to bail, and the court sets the amount and conditions. What helps is being ready: your ties to Selangor, a guarantor (surety) who can come to court, and sensible conditions to offer.

A lawyer puts these together and presents them at the right time. The bail process guide explains what the court looks at and how a surety works. Be wary of anyone who promises a particular result or asks for cash outside the court process.

Get advice before the charge is read

You can get a lawyer’s advice before court. Under Article 5(3) of the Federal Constitution, an arrested person may consult and be defended by a lawyer of their choice, including before any charge [f4].

With advice before the charge is read, you arrive at the first Shah Alam mention knowing your position instead of deciding on the spot. The Shah Alam page has more local detail.

What to do first

You do not need to plan the whole case today. Send a short message about your Shah Alam matter, and you can request contact from an independent lawyer to discuss the mention, bail and later steps.

The Shah Alam courts building

The Shah Alam High Court, Sessions Court and Magistrates’ Court sit at Bangunan Mahkamah Sultan Salahuddin Abdul Aziz Shah, on Persiaran Pegawai in Section 5. [f5] Selangor’s other High Court location is Klang, so read your charge sheet for the court named.

If you are on bail, the court notice will give the date and court for each mention. Come with your surety and your papers, and do not rely on a stranger who offers to sort things out for cash.

For cost help, ask the Legal Aid Department Selangor office [f8] or the Shah Alam legal aid centre run with the Selangor Bar Committee [f7]. A WhatsApp referral needs no trip.

Where is a Shah Alam mule case heard?

Your charge sheet names the court. The prosecution decides whether a Magistrates' Court or Sessions Court hears the case, and later mentions and hearings are listed by the court that has it.

How do I know how serious my charge is?

Look at the section number. Section 424A, holding someone else's account, carries a fine of RM5,000 to RM50,000 or up to five years [f1]. Section 424B, handing over your own account, goes up to seven years [f2]. Section 424C, transactions with no lawful purpose, is heaviest, with 3 to 10 years in jail, or a fine of RM10,000 to RM150,000, or both [f3].

What happens at the first mention?

The charge is read, you say whether you plead guilty or claim trial, and bail can be dealt with. It is not the trial. A lawyer uses it to learn the prosecution's case, apply for bail and fix the next dates, so prepare before you go in.

Can I have a lawyer during questioning, not just in court?

Yes. Article 5(3) of the Federal Constitution lets an arrested person consult and be defended by a lawyer of their choice [f4], including before any charge. Advice before the charge is read means you arrive at the first Shah Alam mention knowing your position.

Which court building do I go to for a Shah Alam mention?

Check the court named on your charge sheet or notice. The Shah Alam courts sit at Persiaran Pegawai, Section 5, and Selangor's other High Court location is Klang [f5].
