Can I appeal if I am convicted?
Yes. You can appeal a conviction to a higher court. You can challenge the conviction, the sentence, or both.
Time is the key point. The period to appeal is short and starts on the date of the decision. As soon as you know you want to appeal, say so and get advice.
An appeal is not a new trial. A higher court checks whether the law was applied correctly and whether the evidence supports the decision. That needs someone who reads the trial record looking for grounds of appeal.
Why must you act quickly?
Missing the deadline can end an appeal. The clock starts on the day of the decision, so waiting to “think about it” can quietly end your chance.
Tell a lawyer you want to appeal before you have worked out the details. Protect your right to appeal first, then work out the grounds. You can choose your own lawyer for the appeal.
What can an appeal achieve?
Depending on what went wrong at trial, an appeal can reduce a sentence, overturn a conviction or send the case back to be decided again. Mule-account charges carry heavy penalties. Section 424C alone carries 3 to 10 years in jail, or a fine of RM10,000 to RM150,000, or both [f3].
With that much at stake, both the conviction and the sentence can be worth reviewing. A lawyer who reads the trial record can tell you which grounds are realistic and which are only hopeful.
What if you are worried about cost?
Do not give up an appeal over money before checking your options. The Legal Aid Department and the National Legal Aid Foundation (YBGK) help people who qualify. YBGK covers criminal appeals subject to a means test [f2].
Ask about fees at the start. The Malaysian Bar Council publishes guidance on how lawyers should set out their fees, so ask for a clear explanation before you agree [f4]. See also finding legal help and what a lawyer can do.

How long do I have to file an appeal?
Not long. The time to appeal is counted from the date of the decision, so do not leave it for later. The safest step is to tell a lawyer you choose straight away that you want to appeal. If you miss the deadline you can lose the appeal altogether.
Can I appeal the sentence as well as the conviction?
Yes. An appeal can challenge the conviction, the sentence, or both, depending on what went wrong at trial. A section 424C conviction can bring 3 to 10 years in jail, or a fine of RM10,000 to RM150,000, or both [f3], so the sentence can be worth reviewing. A lawyer can tell you which grounds are realistic in your case.
What if I cannot afford a lawyer for the appeal?
The Legal Aid Department and the National Legal Aid Foundation (YBGK) help people who qualify, and YBGK covers criminal appeals subject to a means test [f2]. Check their rules early. You can also ask private lawyers about fees: the Bar Council publishes guidance on how lawyers should explain them [f4].
