My business account is frozen and I cannot pay suppliers. What can I do?

A frozen account does not always mean everything stops. You can apply to release money for reasonable business costs while the freeze is in place. Under AMLA section 44A you apply in writing to the enforcement agency to vary a section 44 freeze order, but the release is not automatic [f1].

How do you apply to release money?

Section 44A lets account holders apply in writing to the enforcement agency to release money for reasonable living or business expenses [f1]. That can include supplier payments, payroll and other genuine running costs.

You make a written application to the enforcement agency that froze the account. A more senior officer at the agency decides; it does not go to court.

Because an officer weighs the request, preparation matters. Clear invoices, contracts, payroll records and a plain note of what each payment is for make the request easier to assess. A lawyer can prepare this application for you.

How long can the freeze last?

An agency freeze under AMLA section 44 ends after 90 days if the person is not charged. [f5] A seizure or section 50 order lapses after 18 months without a charge. [f2] That gives you limits to plan around.

A police freeze under section 116D of the CPC (Amendment) Act 2024 works differently. A police officer of Sergeant rank or above can impose it at once, without a court order, and it lapses after 18 months if no prosecution starts [f4]. To vary or lift it, you apply to the Sessions Court.

Who froze the account?

The freeze may be an order by the Public Prosecutor under AMLA section 50(1), used where the money is suspected to come from crime [f3]. Or it may be a police freeze under the 2024 amendment [f4].

The letter or notice you received may state the basis. Finding out early tells you how to respond and who you need to deal with.

What should you do first?

A frozen business account has time limits, and there is a way to ask for money for genuine expenses [f1] [f2]. Neither happens on its own, and both go better with good preparation.

Gather your invoices and records, find out which type of freeze you face, and get advice before you reply or make an application.

Can I get any money out to keep the business running?

Under AMLA section 44A you can apply to vary the freeze so that money is released for reasonable living or business expenses [f1]. It is not automatic: you make a written application to the agency that froze the account, and a more senior officer decides. Prepare clear proof of the costs, such as invoices and payroll, and get advice on how to present it.

How long can my business account stay frozen?

An agency freeze under AMLA section 44 ends after 90 days if the person is not charged. A seizure or section 50 order lapses after 18 months without a charge. A police freeze under the 2024 amendment also lapses after 18 months without a prosecution [f4]. Knowing which one you have tells you the time limit and how to challenge it.

Who actually froze my company account?

It may be an order by the Public Prosecutor under AMLA section 50(1), where the money is suspected to come from crime [f3]. Or it may be a police freeze under the 2024 amendment [f4]. The letter or notice may state the basis, and that tells you who to deal with.
