Can family visit someone on remand?
Family visits during remand are not automatic. They depend on the lockup’s rules and the stage of the investigation. A lawyer’s access to advise the person is different: it is a protected right under Article 5(3) [f1].
How do you ask about a family visit?
Visits depend on the lockup and on how the case is going, so ask directly instead of assuming. Contact the lockup where the person is held and the officer handling the case.
In mule-account cases, the investigation can be run by the Commercial Crime Investigation Department, so its officers can tell you what is allowed [f2]. Be polite and patient, and write down names and dates.
Call before you travel to the lockup. Check the visiting hours and which identity documents to bring, because rules differ between stations. This saves a wasted trip.
Why is a lawyer’s access different?
A lawyer’s access stands on the firmest ground. The right to consult and be defended by a lawyer of one’s choice applies during remand, so a lawyer can ask to see the person and advise them [f1].
This can be the most valuable visit of all. It replaces guesswork with a plan and helps the person understand the questions the investigators are asking [f2].
A lawyer can also attend when the police apply to the magistrate for remand, not only visit the lockup. There, the lawyer can make representations to the magistrate about the remand the police ask for.
What can the family do now?
Keep a simple record: where the person is held, who you spoke to and when. Gather any of the person’s documents that may help, and do not delete anything on shared phones or computers.
If the family lives far from the lockup, ask whether scheduled phone calls are allowed until a visit can be arranged.
If cost is a worry, ask the National Legal Aid Foundation (YBGK) or the Legal Aid Department about eligibility straight away. YBGK covers criminal cases at arrest, remand and bail [f3].
