Can I get bail?

Yes. Sections 424A, 424B and 424C are bailable offences, so bail is a right. The court or police set the amount and conditions, and no one can promise those in advance.

If you are arrested, Article 5(3) of the Federal Constitution says you shall be allowed to consult and be defended by a lawyer of your choice [f1]. That matters most when bail has to be arranged quickly.

What do the amount and conditions depend on?

The court or police weigh several things, including how serious the charge is, whether the person might run, and the risk of interfering with the investigation. Each case is assessed on its own.

The seriousness of the charge is one factor. Penal Code s424C, engaging in transactions through an account without a lawful purpose, is the most serious of the account offences [f2]. Knowing which section applies helps your lawyer plan the right approach.

What is the difference between police bail and court bail?

There are two stages of bail. Before a charge, the police can set bail during the early investigation, so the person can go home while the investigation continues.

After a charge is filed, a magistrate or judge sets the amount and conditions of court bail.

Why does being ready help?

Mule-account cases can be investigated by the Commercial Crime Investigation Department, JSJK [f3]. If things move towards an arrest, speed can matter.

A lawyer who already knows your facts can put a bail application together without delay. That is far better than reacting at the last moment. Get advice early, keep your documents in order and know your rights before you need them.

What happens at a bail hearing?

At a bail hearing the court usually looks at your ties to Malaysia: a fixed address, a job, and family members who can stand as surety. Bringing proof of these helps show the court you will not run.

Bail conditions can include reporting to a police station on set dates, handing over your passport, paying a bail amount, or a surety who promises the court you will turn up. Conditions differ from case to case, so ask your lawyer which are likely to apply to you.

If you break any condition, bail can be cancelled and you may be held until trial. Knowing each condition and keeping to it matters as much as having a lawyer.

If the amount or conditions set are too high, your lawyer can ask the court to review them, including by applying to the High Court.

What decides whether bail is granted?

Sections 424A, 424B and 424C are bailable offences, so bail is a right. The court (or the police, before a charge) sets the amount and conditions. They look at the charge, the risk that the person will run, the risk of interfering with evidence, and the person's circumstances. A lawyer can prepare for the amount and conditions that fit your facts.

Does a more serious charge affect bail?

It can affect the amount and conditions. A charge under Penal Code s424C, engaging in transactions through an account without a lawful purpose, carries a heavier penalty than s424A or s424B. Bail itself remains a right for all three. Find out early which section is involved, so your lawyer can prepare for it.

Should I arrange a lawyer before any arrest?

Getting advice early is sensible, because a lawyer can act quickly if things escalate. If you are arrested, you have the right to consult a lawyer. A lawyer who already knows your facts can prepare a bail application straight away, instead of rushing at the last minute.
