Your rights when a Kota Kinabalu account is frozen

A freeze can feel as if everything has been taken out of your hands. It has not. Even when you cannot reach your money, you still have clear rights.

Knowing what you can ask for and do makes the next step clearer.

A freeze is not a finding of guilt

A freeze holds the money while the matter is investigated. It is not a decision that you did anything wrong, and it can happen before anyone has spoken to you.

If you are arrested, you have the right to consult and be defended by a lawyer of your choice under Article 5(3) of the Federal Constitution [f1].

Which freeze applies to you?

Different laws freeze accounts in different ways. Under section 50 of the Anti-Money Laundering Act (AMLA), the Public Prosecutor can order a freeze on money suspected to come from crime [f2].

A police officer of Sergeant rank or above can also freeze an account under section 116D of the Criminal Procedure Code, without a court order [f3].

A freeze by an enforcement agency under section 44 lasts up to 90 days unless you are charged. An order under section 50 lapses after 18 months if you are not charged (section 52A) [f4]. Knowing which law was used tells a lawyer which steps are open to you. You can compare the two in understanding account freezes.

Sabah advocates are regulated by the Sabah Law Society, not the Malaysian Bar. This matters when you choose who will represent you here.

The Legal Aid Department (Jabatan Bantuan Guaman) has a Sabah office for people whose income qualifies [f5]. Read more about your account holder rights.

The High Court in Sabah and Sarawak at Kota Kinabalu

The freeze law is federal, but the court and the lawyers are local. A Kota Kinabalu case is heard at the High Court in Sabah and Sarawak in the city.

The national Commercial Crime Investigation Department (JSJK/CCID) at Bukit Aman handles these cases. The Sabah police contingent (IPK) and the district police HQ (IPD) are the local offices.

Your first message

You do not need to know every right before you ask for help. A short message about your Kota Kinabalu account and what happened is enough to start. See how a first consultation works.

Freeze paperwork in Kota Kinabalu

The Sabah state courts are listed at Kompleks Kehakiman Kota Kinabalu, No.1 Jalan Kebajikan [f6]. If a police freeze needs to be varied, the application is made to the Sessions Court. Your lawyer files it, so you do not queue at the counter yourself.

If the freeze came from a police officer, the Kota Kinabalu or Penampang district headquarters may be the one named on your notice [f7]. Keep the notice and the bank letter together.

The Legal Aid Department has a Sabah office [f8], and the Sabah Law Society’s Legal Aid Clinic is at Menara MAA, Lorong Api-Api 1 [f9].

What rights do I have if my KK account is frozen?

You can ask why it was frozen, see the reason where it can be shared, and get legal advice. Article 5(3) of the Federal Constitution gives an arrested person the right to consult and be defended by a lawyer of their choice [f1]. A freeze does not take those rights away, even while you cannot reach your money.

Does a freeze mean I am guilty of something?

No. A freeze holds the money while the matter is investigated. It is not a finding against you, and it can happen before anyone has spoken to you. Use the time to gather the records that explain your account.

How do I know which freeze applies to me?

Different laws allow a freeze. Under AMLA section 50, the Public Prosecutor can order one [f2]. A police officer of Sergeant rank or above can also freeze an account under section 116D of the Criminal Procedure Code, without a court order [f3]. A freeze by an enforcement agency under section 44 lasts up to 90 days unless you are charged, and an order under section 50 lapses after 18 months if you are not charged (section 52A) [f4].

Who can represent me in Sabah?

Sabah advocates are regulated by the Sabah Law Society, not the Malaysian Bar. The Legal Aid Department (Jabatan Bantuan Guaman) has a Sabah office for people whose income qualifies [f5]. Ask about it early if cost is a worry.

Is the freeze law different in Kota Kinabalu?

No. AMLA and the Criminal Procedure Code are federal laws and apply the same way in Sabah. What differs is the court and the legal profession. A Kota Kinabalu case is heard at the High Court in Sabah and Sarawak in the city, and the national Commercial Crime Investigation Department (JSJK/CCID) at Bukit Aman handles these cases.

Which Kota Kinabalu office handles my freeze, the bank or the police?

The bank letter should name the order or agency. If it names the police, check whether the district is Kota Kinabalu or Penampang [f7]. If it names no one, ask the bank in writing and show the reply to your lawyer.
